WH E R E A S voted a s u m of money towards es tabl ishing Schools to be con­
ducted u n d e r Lord Stanley 's Na t iona l Sys tem of Educa t ion A n d
t h e Legis la t ive Counci l of N e w Sou th W a l e s has

whereas H i s Excel lency t h e Governor has appoin ted a Board of Com­ missioners for admin i s te r ing t h e said fund and for t h e purpose of supe r in tend ing t h e format ion and m a n a g e m e n t of Schools of t h a t class A n d whereas i t is deemed expedient and necessary t ha t t he said Board of Commissioners should be incorpora ted Be i t enacted by H i s

Excel lency t h e Governor of N e w Sou th W a l e s w i th t h e advice and
consent of t h e Legis la t ive Counci l thereof T h a t t h e said Board so
appoin ted consis t ing of J o h n H u b e r t P l u n k e t t Char les Nicholson and

Wi l l i am Sharpe Macleay Esqui res and the i r successors for ever to be appoin ted as in m a n n e r hereinaf ter is provided shal l be one body polit ic and corporate by t h e n a m e and style of " The Board of Na t iona l E d u c a t i o n " and shal l by t h a t n a m e have pe rpe tua l succession and a common seal and shal l by t h e same n a m e from t ime to t i m e and a t all t imes hereafter be able and capable to have t ake receive purchase; acqui re hold possess and enjoy to t h e m and the i r successors as members of t he said Board to a n d for t h e uses of t he said Corporat ion any messuages l ands t enemen t s he red i t ament s of w h a t n a t u r e k ind or

A n d be i t enacted Tha t i t shall be lawful for t h e Governor w i th t he advice of t he Execu t ive Council to remove any m e m b e r or member s of t he said Corporat ion and to appoin t ano ther or o thers in his or the i r s tead and as often as any vacancy shall occur by t h e death res ignat ion or absence from t h e Colony of any of t he members of t h e said
qua l i ty soever s i tua te ly ing a n d be ing wi th in t h e said Colony a n d also

to t a k e receive purchase acqui re have hold and possess to a n d for t h e same uses and purposes any goods chat te l s gifts or benefact ions wha t ­ soever and shall a n d may by t h e same n a m e be able and capable to sue a n d to be sued b o t h a t L a w a n d in E q u i t y in as large a m p l e and beneficial a m a n n e r a n d form as any other body pol i t ic or corporate or any persons able and capable to sue and be sued e i ther in Law or

in E q u i t y in any m a n n e r whatsoever .

said Corporat ion t h e n and in every case in which i t shal l he made to appea r to t h e satisfaction of t h e Governor of t he said Colony tha t any of t he said member s are unab le or unwi l l ing to discharge t h e dut ies devolving on the said Corporat ion i t shall and m a y be lawful for the said Governor to n o m i n a t e and appoin t a successor or successors to such m e m b e r or members and all such appo in tments shall be publ i shed in t h e New South Wales Government Gazette u p o n which the person or persons so appointed shall to all in ten ts and purposes be invested wi th t h e same powers author i t ies capabil i t ies and privileges in Law

a n d E q u i t y as t h e member or m e m b e r s in whose stead be or they

shal l be so appointed to succeed had held and enjoyed.
3 . A n d be it enacted Tha t t h e said Corpora t ion shal l have power and au thor i ty to form and m a k e by-laws rules and orders t ouch ing and concerning t h e good government of t he said Corporat ion and t h e income and proper ty thereof and any other m a i l e r or t h i n g relat ive to t h e same which to t h e m may seem (it and expedient for the effectual a t t a inmen t of the objects of t h e said Corporat ion and t h e admin i s t ra t ion of i ts concerns and also from t ime to t ime by such new by-laws rules and orders as to t h e m shall seem meet to a l ter or repeal those so made as aforesaid a n d all such by-laws ru les and orders shall wi th in one m o n t h from the da te thereof lie publ ished in t h e New South

Wales Government Gazette and shall be laid before t h e Legislat ive
Counci l w i th in one m o n t h after t h e commencement of the nex t ensu ing
Session.
