s1 2 s5 National Crime Authority (State Provisions) No. 199, 1996 Amendment (No. 1) ˙ Short title 1. This regulation may be cited as the National Crime Authority (State Provisions) Amendment Regulation (No. 1) 1996 . ˙ Regulation amended 2. This regulation amends the NationalCrimeAuthority(StateProvisions) Regulation 1986 . ˙ Insertion of new s 1A 3. After section 1— insert ˙ Definition 1A. In this regulation— “approved form” see section 2.’. ˙ Replacement of s 2 (Forms) 4. Section 2— omit, insert Forms 2. The chief executive may approve forms for use under the Act.’. ˙ Amendment of s 3 (Search warrant) 5. Section 3, ‘Form 1.’— omit, insert ‘the approved form. 1 ’. 1 Section 12(5) of the Act states what information the form must contain.

Section 4— omit . ˙ Amendment of s 5 (Notice to produce) 7. Section 5, ‘Form 3.’— omit, insert ‘the approved form. 2 ’. ˙ Amendment of s 6 (Service of summons or notice) 8.(1) Section 6(1)(a)(iii) and (2), ‘member or acting member’— omit, insert ‘judge’. (2) Section 6— insert (3) In this section— “judge” means a Federal Court judge or a Supreme Court judge.’. ˙ Amendment of s 7 (Warrant for arrest of witness) 9.(1) Section 7, ‘Form 4’— omit, insert ‘the approved form’. (2) Section 7— insert (2) An approved form for a warrant for the apprehension of a person must include provision for the following— 2 Section 18(1) of the Act states what information the form must contain.
s 10 4 s 10 National Crime Authority (State Provisions) No. 199, 1996 Amendment (No. 1) (a) a statement that the judge is satisfied, by evidence given on oath, that there are reasonable grounds to believe that the person to be apprehended— (i) has been ordered under section 15 of the Actto give the person’s passport to the Authority and, whether or not the person has complied with the order, is likely to leave Australia to avoid giving evidence before the Authority; or (ii) has been issued with a summons to appear before the Authority to give evidence and to produce documents or other things and— (A) has absconded or is likely to abscond; or (B) is otherwise attempting, or likely to attempt, to evade service of the summons; or (iii) has committed, or is likely to commit, an offence under section 19(1) of the Act; (b) the full name of the person to whom it is addressed; (c) the full name and address of the person to be apprehended; (d) the full name of the applicant for the warrant; (e) the full name of the judge issuing it; (f) a direction to apprehend the person and bring the person, as soon as practicable, before a judge of the court to be dealt with according to law. (3) The warrant must also be signed by the judge issuing it and state the judge’s designation.’. ˙ Insertion of new s 8 10. After section 7— insert ˙ Transitional provision about forms 8.(1) This section applies if—
s 11 5 s 11 National Crime Authority (State Provisions) No. 199, 1996 Amendment (No. 1) (a) immediately before its commencement, there was a prescribed form for a matter; and (b) on the commencement, there is to be an approved form for the matter. (2) The form that was the prescribed form for the matter immediately before the commencement is taken to be the approved form for the matter until there is an approved form for the matter or this section expires, whichever happens first.
