  1. The applicant requires an extension of time within which to seek special leave to appeal from the whole of the judgment of the Court of Appeal of the Supreme Court of Western Australia (Buss P, Mitchell and Vaughan JJA) which dismissed the applicant's appeal from a decision of the District Court of Western Australia (Gething DCJ). The proposed appeal does not raise a question of general importance and lacks sufficient prospects of success to grant special leave to appeal. It would therefore be futile to grant the extension of time that is sought.

  2. Special leave to appeal is refused with costs.
