declare that it was expedient to carry out a cer ta in work, namely , WH E R E A S , in accordance wi th the provisions of the Publ ic W o r k s Act , 1900, the Legislat ive Assembly did, by resolution,
t h e construct ion of a line of railway from Nar romine to Peak H i l l : A n d whereas, on the passing of the said resolution, a s t a tu to ry du ty was by the said Act imposed on the Secretary for Pub l i c Works to in t roduce a Pil l into the said Assembly to sanction the ca r ry ing out of t he said w o r k : Be it- therefore enacted by the K i n g ' s most Exce l len t Majesty, by and with the advice and consent of t he Legislat ive Counci l and Legislat ive Assembly of New South Wales in Par l iament Assembled, and by the au thor i ty of the same, as follows :—
1. This Act may be cited as the " Nar romine to Peak Hi l l
2. The car ry ing out the said work (more par t icular ly described in t he Schedule to this Act) is hereby sanctioned ; and the Secretary for P u b l i c W o r k s , or the M e m b e r of the Execu t i ve Council for the t ime being performing the dut ies of the said Secretary, is hereby author ised to u n d e r t a k e and carry out the said work, subject to the provisions of th is Act , and for that purpose shall be, and shall have the powers and duties of a Cons t ruc t ing Au thor i ty within the m e a n i n g of t he Public W o r k s Act, 1900.

hundred and twenty-one thousand throe hundred and seventeen pounds , shall be defrayed from such Loan Votes as are now or m a y hereaf ter be appl icable to t h a t purpose, or from appropr ia t ions of the
| Pub l i c W o r k s Fund, or par t ly from | such votes and par t ly from | the |
| said appropr ia t ions , and shall not under any c i rcumstances exceed | t h e |
| es t imated cost by more t han ten per | c e n t u m . |
5 . The said line of ra i lway m a y be cons t ruc ted on or a long or
by t he side of any publ ic road or h ighway.
6 . No tw i th s t and ing the provisions of section e ighty-four of t he

requi red or compelled, nor shall it be the du ty of t he said Au tho r i t y , to m a k e or main ta in any fence a long the said line of ra i lway for t he accommodat ion of any person or for any purpose whatsoever ; bu t the said Au tho r i t y may, in his discretion, m a k e and ma in ta in such fences in connect ion wi th t he said l ine of ra i lway as he may t h i n k fit.
