GLEESON CJ:   Is the applicant here in this matter?  Officer, will you please call outside the Court matter NACE of 2002.

COURT OFFICER:   There is no response, your Honour.

GLEESON CJ:   In matter No S111 of 2003, the application of NACE of 2002, there has been no appearance for the applicant.  We have read the written submissions filed on behalf of the applicant.  The Court is of the view that there are insufficient prospects of success of an appeal to warrant a grant of special leave, and the application is refused with costs.
