HAYNE J: The applicant, a citizen of India, seeks special leave to appeal against the orders of a single judge of the Federal Court of Australia (Marshall J) exercising the appellate jurisdiction of that Court. By those orders, Marshall J refused the applicant leave to appeal against orders of the Federal Magistrates Court dismissing an application to set aside an earlier order of the Federal Magistrates Court, dismissing, for want of appearance, the applicant’s application for relief under s 39B of the Judiciary Act 1903 (Cth).
The applicant’s written submissions in support of the application for special leave raise no question of principle which would warrant consideration by this Court, nor do they identify any error of law in the decisions below, or any jurisdictional error in the decision of the Tribunal.
Pursuant to r 41.11.1 we direct the Registrar to draw up, sign and seal an order dismissing the application with costs. I publish that disposition.
AT 9.34 AM THE MATTER WAS CONCLUDED
