JUDGMENT
HIS HONOUR: This is an application pursuant to section 43 of the Personal Injuries Proceedings Act 2002, for leave to commence proceeding despite non-compliance of the pre-Court procedures. The basis upon which the application is made is the imminent expiry of the limitations period which will occur on the 20th of April 2004.
I am satisfied in the circumstances that leave to commence proceedings should be given on the basis that the action be further stayed until the pre-Court procedures have been complied with. That is the terms of the draft order which I will now initial and mark and place with the papers.
