Part 1Preliminary1Name of regulation

This regulation is the Museum of Applied Arts and Sciences Regulation 2024.

2Commencement

This regulation commences on the day on which it is published on the NSW legislation website.

Note—

This regulation repeals and replaces the Museum of Applied Arts and Sciences Regulation 2017, which would otherwise be repealed on 1 September 2024 by the Subordinate Legislation Act 1989, section 10(2).

3Definitions

In this regulation—

Chief Executive means the person employed in the Public Service as the Chief Executive of the Museum of Applied Arts and Sciences.

President means the President of the Trustees of the Museum of Applied Arts and Sciences nominated under the Act, section 8(1).

the Act means the Museum of Applied Arts and Sciences Act 1945.

Note—

The Act and the Interpretation Act 1987 contain definitions and other provisions that affect the interpretation and application of this regulation.

Part 2Proceedings of trustees—the Act, ss 9(1) and 18(1)(b)4Ordinary meetings

An ordinary meeting may be called by—

  • (a)

    the President, or

  • (b)

    if the President agrees—a trustee.

5Special meetings

A special meeting may be called—

  • (a)

    by the President, or

  • (b)

    at the request of at least 3 trustees, or

  • (c)

    by the Chief Executive.

6Notice of meetings

The trustees must be given at least 3 days notice of the following—

  • (a)

    the day, time and place of the following—

    • (i)

      an ordinary meeting,

    • (ii)

      a special meeting,

    • (iii)

      an adjourned meeting under section 7,

  • (b)

    the business proposed to be considered at the meeting.

7Adjourned meetings(1)

If the quorum for an ordinary meeting or special meeting is not present within 15 minutes after the time of the meeting, the meeting must be adjourned to a day determined by the trustee or trustees present.

(2)

If no trustees are present within 15 minutes after the time of the meeting, the business of the meeting stands adjourned until the next meeting.

8Chief Executive entitled to attend meetings

The Chief Executive may—

  • (a)

    attend an ordinary meeting or special meeting, and

  • (b)

    be heard on a matter before the meeting.

9Committees(1)

The trustees may—

  • (a)

    establish committees in relation to an aspect of the Museum’s activities, and

  • (b)

    determine the terms of reference of committees, and

  • (c)

    appoint a member of a committee as the chair of the committee.

(2)

The President and the Chief Executive are, because of holding office as the President and the Chief Executive, members of a committee established under subsection (1).

(3)

The President may preside at a meeting of a committee.

(4)

If the President is absent or declines to preside at a meeting of a committee—

  • (a)

    the chair of the committee must preside, or

  • (b)

    if the chair is absent or declines to preside—another member of the committee appointed by and from the members present must preside.

Part 3Management of Museum10Chief Executive—the Act, s 18(1)(a)(1)

The Chief Executive is responsible to the trustees for—

  • (a)

    the administration and management of the Museum, and

  • (b)

    the services provided in connection with the Museum.

(2)

The Chief Executive must give the trustees a report on the matters set out in subsection (1)(a) and (b).

(3)

The trustees may determine when the Chief Executive must provide reports under subsection (2).

11Outgoing loans of exhibits and specimens—the Act, s 18(1)(d) and (e)(1)

A person or body may borrow an exhibit or specimen held by the Museum if the Chief Executive permits the exhibit or specimen to be borrowed by the person or body.

(2)

Exhibits and specimens held by the Museum must not be lent to a person or body without the permission of the Chief Executive under subsection (1).

12Incoming loans of exhibits and specimens—the Act, s 18(1)(a) and (e)

The Chief Executive may accept an exhibit or specimen on loan from another person or body.

13Admission to Museum—the Act, s 18(1)(c)

The trustees may determine the days and times when the Museum is open to the public.

Part 4Miscellaneous14Repeal and savings(1)

The Museum of Applied Arts and Sciences Regulation 2017 is repealed.

(2)

An act, matter or thing that, immediately before the repeal of the Museum of Applied Arts and Sciences Regulation 2017, had effect under that regulation continues to have effect under this regulation.
