Museum of Applied Arts and Sciences Regulation 1997 (NSW)

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Museum of Applied Arts and Sciences Act 1945.

Part 1Preliminary1Name of Regulation

This Regulation is the Museum of Applied Arts and Sciences Regulation 1997.

2Commencement

This Regulation commences on 1 September 1997.

3Definitions

In this Regulation:

Director means the Director of the Museum.

meeting means a meeting of the trustees.

member of staff means a member of staff of the Museum.

Museum means the Museum of Applied Arts and Sciences, and includes any branch of the Museum.

President means the President of the Trustees of the Museum of Applied Arts and Sciences.

the Act means the Museum of Applied Arts and Sciences Act 1945.

The explanatory note and table of contents do not form part of this Regulation.

Part 2Proceedings of the trustees5Ordinary meetings

Ordinary meetings are to be held at times determined by the trustees, or at the discretion of the President.

6Special meetings

Special meetings may be called at the request of the Director, the President or any 3 trustees.

7Notice of meetings

The trustees are to be given at least 3 days’ notice of:

• (a)

  the day, time and place of each meeting, and

• (b)

  the business to be considered at the meeting.

8Adjourned meetings(1)

If the quorum for a meeting is not present within 15 minutes of the time specified in the notice calling the meeting, the meeting is to be adjourned to a day to be specified by the trustee or trustees then present.

(2)

If there are no trustees present within 15 minutes of the time specified in the notice calling the meeting, the business of the meeting is to stand adjourned until the next meeting.

(3)

Clause 7 applies in relation to an adjourned meeting in the same way as it applies to any other meeting.

9Director entitled to attend meetings

The Director has the right to attend any meeting of the trustees and to be heard on any matter before the meeting.

10Committees(1)

The trustees may appoint committees in relation to any aspect of the Museum’s activities and may appoint a member of any such committee as the senior member of the committee.

(2)

The President and the Director are, by virtue of holding office as such, members of any committee so appointed.

(3)

The President has the right to preside at any meeting of a committee.

(4)

If the President is absent or declines to preside:

• (a)

  the senior member of the committee is to preside, or

• (b)

  if the senior member is absent or declines to preside, another member of the committee (appointed by and from the members present) is to preside.

Part 3Management of the museum11The Director(1)

The Director is responsible to the trustees for the administration and management of the Museum and for any services provided in connection with the Museum.

(2)

The Director is to furnish the trustees, at such times as they may determine, with a report on the activities of the Museum and its staff.

12Loans of exhibits to other bodies(1)

The trustees may permit an exhibit that is on display to be lent to any other person or body.

(2)

The Director may permit an exhibit that is held in reserve to be lent to any other person or body.

(3)

Exhibits may not be lent otherwise than in accordance with this clause.

13Accepting loans of exhibits from other bodies

The Director may accept an exhibit on loan from any other person or body.

14Admission to the Museum

The Museum is to be open to the public on such days and at such times as the trustees may from time to time determine.

Part 4Miscellaneous15Repeal(1)

The Museum of Applied Arts and Sciences Regulation 1992 is repealed.

(2)

Any act, matter or thing that, immediately before the repeal of the Museum of Applied Arts and Sciences Regulation 1992, was done for the purposes of, or had effect under, that Regulation is taken to have been done for the purposes of, or continues to have effect under, this Regulation.
