REGULATION

(Museum of Applied Arts and Sciences Regulation 1992)

HIS Excellency the Governor, with the advice of the Executive Council, and on the recommendation of the Trustees of the Museum of Applied Arts and Sciences, and in pursuance of the Museum of Applied Arts and Sciences Act 1945, has been pleased to make the Regulation set forth hereunder.

PART 1—PRELIMINARY

Citation

1. This Regulation may be cited as the Museum of Applied Arts and

Sciences Regulation 1992.

Commencement

2. This Regulation commences on 1st September, 1992.

Definitions

3. In this Regulation:
“Director” means the Director of the Museum;
“meeting” means a meeting of the trustees;
“member of staff” means a member of staff of the Museum;

“Museum” means the Museum of Applied Arts and Sciences, and

includes any branch of the Museum;

“President” means the President of the Trustees of the Museum of

Applied Arts and Sciences;

“the Act” means the Museum of Applied Arts and Sciences Act

1945;

“visitor” means a person (other than a trustee or a member of staff)

who is on the premises of the Museum.

PART 2—PROCEEDINGS OF THE TRUSTEES

Ordinary meetings

4. Ordinary meetings are to be held at such times as are determined by the trustees, or at the discretion of the President.

Special meetings

5. Special meetings may be called at the request of the Director, the President or any 3 trustees.

Notice of meetings

6. The trustees are to be given at least 3 days’ notice of the day, hour

and place of, and of the business to be considered at, each meeting.

Adjourned meetings

7. (1) If the quorum for a meeting is not present within 15 minutes of the time specified in the notice calling the meeting, the meeting is to be adjourned to a day to be specified by the trustee or trustees then present.

(2) If no trustees are present within 15 minutes of the time specified in

the notice calling the meeting, the business of the meeting is to stand
adjourned until the next meeting.

Director entitled to attend meetings etc.

8. The Director has the right to attend any meeting of the trustees and

to be heard on any matter before the meeting.

Committees

9. (1) The trustees may appoint committees in relation to any aspect of the Museum’s activities and may appoint a member of any such

committee as the senior member of the committee.

(2) The President and the Director are, by virtue of holding office as

such, members of any committee, so appointed.

(3) The President has the right to preside at any meeting of a committee.

(4) In the event that the President is absent or declines to preside:

(a) the senior member of the committee is to preside; or

(b)

if the senior member is absent or declines to preside, another member of the committee (appointed by and from the members present) is to preside.

PART 3—MANAGEMENT OF THE MUSEUM

The Director

10. (1) The Director is the chief executive officer to the trustees.

(2) The Director is responsible to the trustees for the administration

and management of the Museum and for any services provided in
connection with the Museum.

(3) The Director is to furnish the trustees, at such times as they may

determine, with a report on the activities of the Museum and its staff.

Loans of exhibits to other bodies

11. (1) The trustees may permit an exhibit that is on display to be lent

to any other person or body.

(2) The Director may permit an exhibit that is held in reserve to be lent to any other person or body.

(3) Exhibits may not be lent otherwise than in accordance with this

clause.

Accepting loans of exhibits from other bodies

12. The Director may accept an exhibit on loan from any other person or body.

PART 4—VISITORS TO THE MUSEUM

Admission to the Museum

13. The Museum is to be open to the public on such days and at such

times as the trustees may from time to time determine.

Closed sections

14. A visitor must not enter any portion of the Museum that is not open to the public unless authorised by the Director or by the member of

staff in charge of that portion.

Maximum penalty: $40.

Baggage

15. (1) A visitor must not bring any stick, umbrella, parcel, suitcase or

other like article into the Museum.

Maximum penalty: $40.

(2) This clause does not prevent a visitor from depositing a stick,

umbrella, parcel, suitcase or other like article with the attendant at the

main door of the Museum.

Offensive behaviour

16. (1) Any member of staff may request a visitor to leave the

Museum if the visitor is behaving in an offensive manner.

(2) A visitor must not fail to leave the Museum if so requested by a

member of staff.

Maximum penalty: $40.

Handling Museum exhibits

17. A visitor must not handle any Museum exhibit otherwise than in

accordance with the permission of the Director or of a member of staff
authorised by the Director to give such permission.

Maximum penalty: $40.

Photographing exhibits

18. (1) A visitor must not take a photograph of any exhibit otherwise

than in accordance with the permission of the Director or of a member of

staff authorised by the Director to give such permission.

Maximum penalty: $40.

(2) Permission may not be given under this clause in respect of an

exhbit that is on loan from any other body or person.

PART 5—GENERAL

Banking of money

19. (1) All money held by the trustees is to be kept in an account at such bank or banks as the trustees may from time to time determine.

(2) Money may not be withdrawn from any such account otherwise than by means of a cheque:

(a)

signed by the Director or by some other member of staff authorised by the trustees to sign cheques; and

(b)

countersigned by a trustee or by some other person authorised by the trustees to countersign cheques.

Repeal

20. The Regulations in force under the Act immediately before the commencement of this Regulation are repealed.

EXPLANATORY NOTE

The object of this Regulation is to repeal the regulations currently in force under

the Museum of Applied Arts and Sciences Act 1945 and to replace them with a
new Regulation. The new Regulation deals with the following matters:

(a)

the proceedings of the Trustees of the Museum of Applied Arts and Sciences (Part 2); and

(b)

the management of the Museum, including the functions of the Director of the Museum and the lending and borrowing of Museum exhibits (Part 3); and

(c)

the regulation of the admission of visitors to the Museum and the behaviour of visitors in the Museum (Part 4); and

(d) other minor, consequential and ancillary matters (Parts 1 and 5).

This Regulation is made in connection with the staged repeal of subordinate legislation under the Subordinate Legislation Act 1989.
