AN ACT to amend the Museum Act 1969-1973.

[Assented to 31 May 1984.]

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent

of the Legislative Council and the Legislative

Assembly of Western Australia, in this present

Parliament assembled, and by the authority of the

same, as follows:—

1. (1) This Act may be cited as the Museum

Short title

and citation.

Amendment Act 1984.

(2) In this Act the Museum Act 19694973 is

of 1969 as

amended by

referred to as the principal Act.

(3) The principal Act as amended by this Act

may be cited as the Museum Act 1969-1984.

amended.

2. Section 3 of the principal Act is amended by deleting "MUNICIPAL" and substituting the following.

RECOGNIZED ".

Section 23

amended.

3. (1) Section 23 of the principal Act is

amended

(a)

by inserting after the section designation "23." the subsection designation "(1)";

(b)

by deleting "Museum, to hold office during the Trustees' pleasure." and substituting the following-

" Museum. ";

(c) by inserting the following subsections

(2) Subject to subsection (3) of this section, an Honorary Associate shall hold office for such term not exceeding

4 years as is specified in the instru-

ment of his appointment.

(3) The Governor may terminate the term of office of an Honorary Associate at any time. ".

(2) Notwithstanding anything in section 23 of the principal Act as in force immediately before the commencement date but subject to section 23 (3) of the principal Act as enacted by subsection (1) of this section, every Honorary Associate holding office immediately before the commencement date shall be deemed to have been appointed for a period of 4 years commencing from the commencement date.

(3) In subsection (2) of this section "commence- ment date" means the date on which this Act comes into operation.

is amended by deleting "MUNICIPAL" and sub-

stituting the following-

" RECOGNIZED ".

5.    Section 37 of the principal Act is amended— amended..

(a)

by repealing subsection (1) and substitut- ing the following subsection

C'

(1) Where

(a)

under the Local Government Act 1960, a local authority; or

(b)

any body of persons (whether incorporated or not) having among its principal objects the promotion of interest in history, natural history or any other matters approved of by the Trustees having regard to their functions under this Act,

proposes to establish, or has estab- lished, a museum, it may apply to the Trustees for their recognition of the museum. ";

(b)

in subsection (2) by deleting "municipal" wherever occurring;

(c) in subsection (3)-

(i) by deleting "municipal";

(ii)   in paragraph (a), by deleting "the local authority or is leased by the local authority under conditions satisfactory to the Trustees" and substituting the following

C' or leased under conditions that

are satisfactory to the Trustees to a person or body of persons approved by the Trustees ";

(iii)   in paragraph (b), by deleting "of the local authority";

(iv)

by deleting "and" after paragraph

(b);

(v)  by inserting after paragraph (b) the following paragraph-

" (ba) the collection held or proposed to be held by the museum, is, in the opinion of the Trustees, significant; and "; and

(vi)    in paragraph (c) by inserting after "authority" the following-

" or the body of persons, as the

case requires ";

and

(d) in subsection (4)-

(i)

by deleting "municipal" wherever

occurring; and

(ii)   by inserting after "extended by the Trustees" the following-

" under this section ".

amended.

6. Section 51 of the principal Act is amended in subsection (2) by deleting "municipal museums" in paragraph (c) and substituting the following-

" museums recognized under Part IV of this

Act ".
