AN ACT to amend the Murdoch University Act 1973-1978 and to validate certain by-laws of the University.

[Assented to 23 October 1980.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

Short title

1. (1) This Act may be cited as the Murdoch and citation.

University Amendment Act 1980.

(2) In this Act the Murdoch University Act amended by

1973-1978 is referred to as the principal Act.	Acts Nos. 103of 1975, 38 of
1976, 61 of 1977 and 7 of 1978.

(3) The principal Act as amended by this Act may be cited as the Murdoch University Act 1973- 1980.

Commence-

ment. 2. (1) This Act, other than section 3 (a) (ii)

shall come into operation on the day on which it

is assented to by the Governor.

(2) Section 3 (a) (ii) shall come into operation

on a day to be fixed by proclamation.

Section 12

amended. 3. Section 12 of the principal Act is amended—

(a) as to subsection (1)-

(i)  by deleting "three" in line one of paragraph (d) and substituting the following-

" four " ;

(ii)    by inserting after paragraph (d) the following paragraph-

" (da) one person elected in the manner prescribed by Statute by and from amongst the full-time officers and servants of the University who are not members of the full- time academic staff of the University; " ;

(iii)   by inserting after "time" in line two of paragraph (j) the following-

" and not being full-time members of the academic staff of the University or full-time officers or servants of the University or any other tertiary educational institution "

and

(b) as to subsection (2)-

(i)   by inserting after "officer" in line three of paragraph (a) the following-

" or servant " ;

(ii)   by inserting after "paragraphs" in line five of paragraph (a) the following-

PI ;

" (f),

(iii)   by inserting after "officer" in line two of paragraph (b) the following-

" or servant " .

4. Section 24 of the principal Act is amended, =dnec214

as to subsection (7)—

(a) by inserting after "of" in line two of paragraph (ab) the following-

" permits or " ;

(b) by inserting after "those" in line four of paragraph (ab) the following-

" permits or "; and

(c) by inserting after "which" in line four of paragraph (ba) the following-

" the person to whom a permit is issued

in respect of a vehicle or " .

5. A by-law made or purportedly made pursuant Validation.

(a) providing for the issuing of permits to persons and requiring the production of

a permit by the person in respect of whom it was issued whenever required by an authorized person; or

(b) providing that a person in respect of whom a permit is issued in respect of a vehicle is deemed to be the driver or person in charge of the vehicle at the time of an alleged breach of a by-law made under that section,

is hereby declared not to be and not to have been

invalid by reason only of such a provision.
