An Act to provide for the l i g h t i n g by e lectr ic i ty
of munic ipal i t i es ; to apply the provis ions of

the Munic ipal i t ies Act , 1897, re lat ing to municipal gasworks and gas to municipal e lectric l ight works and e lectr ic i ty ; and for other purposes . [29th December, 1904.]

BE it enacted by the K ing ' s Most Exce l l en t Majesty , by and with the advice and consent of t he Legislat ive Council and Legislat ive
Assembly of N e w South Wales in P a r l i a m e n t assembled, and by t h e

au thor i ty of t he same, as follows : —

1. This Act may be cited as the " Munic ipa l i t ies Elect r ic L igh t

Ac t , 1904 ."

2. I n this A c t the express ion—

" Elec t r i c l igh t works " means and includes t ransformers , fittings,

and appara tus for the supply of electr ici ty, also any bui ldings , machinery , engines , ma t te r s or th ings of whatever descript ion required to genera te or supply electrici ty, and to carry in to effect t he purpose of th is Act .

" E l e c t r i c i t y " means electricity, electric cur ren t , or any like

agency.

3. The provisions of t h e Municipal i t ies Act , 1897, re la t ing to

munic ipa l gasworks and gas shall , as far as they art; applicable, apply

m u t a t i s mu tand i s to munic ipa l electric l ight works and electricity.

4. No council shall enter into any contract for, or unde r t ake t he erection or purchase of, electric l ight works un t i l a vote of the ra tepayers on t he question whe the r the munic ipa l i ty should be l ighted by electricity shall have been t aken , and unless t he vote shall have been in t h e affirmative. The council may m a k e by-laws regu la t ing t he t ak ing of the vote of the ra tepayers .

5. This Act shall in no way affect any o ther Act , publ ic or

pr iva te , passed before the c o m m e n c e m e n t of this Ac t , and deal ing
wi th t he electric l igh t ing of any munic ipa l i ty .
