AN ACT to amend the Municipal Institutions

Act, 1900.

[Assented to 16th January, 1904.]

E it enacted by the King's Most Excellent Majesty, by and

with the advice and consent of the Legislative Council and

Legislative A ssembly of Western Australia, in this present Parlia-

ment assembled, and by the authority of the same, as follows:—

1.     THIS Act may be cited as the Municipal Institutions Act Short title.

Amendment Act, 1904, and shall be read as one with the Muni- cipal Institutions Act, 1900.

2.	EVERY municipal council shall have, and shall be deemed	Power for Municipal

to have had, from the passing of the Municipal Institutions Act,	stone, etc.

(I.) To work quarries acquired by the council, and to employ persons, and to provide machinery, apparatus, horses, and plant in and for such work ;

( 2 .) To defray the cost and expenses of and incidental thereto

out of the ordinary income of the council ; and

(3 .) To use the stone or other material obtained from any

quarry for the , purposes of the municipality.

Provision as to 3. NO action shall be brought or continued against any muni-

legal proceedings. cipal council in respect of any act, matter, or thing done before the passing of this Act which might have been lawfully done if this Act had been in force at the dine of the doing of such act, matter, or thing ; but the plaintiff in any such action pending at the commence- ment of this Act shall be entitled to recover against the defendant such costs, as between party and party, as may have been incurred by the plaintiff prior to the passing of this Act.

Union of munici- 4. NOTWITHSTANDING any provisions of the principal

polities of Broad	Arrow and Padding- Act, the proclamation published in the Government Gazette on the
ton validated. twenty-third day of October, One thousand nine hundred and three, whereby the municipalities of Broad Arrow and Paddington were united to form one municipality under the name of "The Mayor and Councillors of Broad Arrow-Paddington" is hereby declared to be valid, and the said municipalities shall be deemed to have been lawfully united so as to form one municipality as from the date of the publication of such proclamation.
Dissolution of
Gingin muni- 5. THE municipality of Gingin is dissolved, and the district
cipality. thereof is included in and shall henceforth form part of the Gingin road district; and all the property, assets, and liabilities of such municipality are hereby vested in and shall attach to the Board of the Gingin road district.
