p u r p o s e of o b t a i n i n g p l a n s , e s t i m a t e s , o r r e p o r t s a s t o t h e c o s t of
p u r c h a s i n g , l e a s i n g , a c q u i r i n g , a n d c o n s t r u c t i n g w o r k s for t h e g e n e r a ­
t i o n a n d s u p p l y of e l e c t r i c i t y , a n d for t h e p u r p o s e of d e f r a y i n g t h e
e x p e n s e s i n c u r r e d i n c o n n e c t i o n w i t h t h e p r e p a r a t i o n a n d i n t r o d u c t i o n
of t h e B i l l for t h i s A c t : P r o v i d e d t h a t i n t h e e v e n t of s u c h w o r k s

For the purpose of this section a te legraph or telephone line or o ther publ ic l ine shall be deemed to be injuriously affected if te legraphic or te lephonic communica t ion by means of such line, whe the r t h r o u g h induct ion or otherwise, is affected by any electric l ine or work of the Council, or by any use made of such electric line or work.

18. One m o n t h a t least before commenc ing the execution of any works which involve t he p lac ing of works in, under , a long, or across any street, h ighway, or publ ic bridge, on which any te legraph, telephone, or ra i lway line may be (not being repairs to or renewals of t hen exis t ing works of which the character and positions are not al tered), the Council or its agents shall serve upon t h e Secretary for Publ ic W o r k s and Postmaster-General , t h e Metropol i tan Board of W a t e r Supply and Sewerage, the Aus t ra l ian Gaslight Company, and such other person or corporat ion as the Secretary for Public; W o r k s m a y by wr i t ing under his h a n d addressed to t he Council r equ i re to be notified, or leave at thei r respective offices addressed to t h e m , notices describing the proposed works, and the gauge; of any electric l ine and the cur ren t and potent ia l to be carried, toge ther with a p lan of t he proposed works showing t h e position of t he said works and the mode in which the works are in tended to be executed and the manne r in which il is intended tha t the street , h ighway, or bridge shall be interfered with, and shall at the request of t he Secretary for Pub l i c W o r k s or Postmaster-General , made a t any t ime, give them, such fur ther information with reference to the works as they may desire. If any works arc commenced before the requi rements of this section have been complied with, the Secretary for Pub l i c W o r k s or Postmaster - Genera l m a y cause the said works to bo removed, and the Council shall be liable to a penal ty not exceeding fifty pounds, which may he

recovered before any st ipendiary magis t ra te in a s u m m a r y way.

19. I n t he exercise of its powers unde r th i s A c t the Council shal l cause as l i t t le det r iment and inconvenience, and do as l i t t le damage as possible, and shall make full compensat ion to all persons for all damage sustained by t h e m by reason or in consequence of t h e exercise of such powers, t he a m o u n t of such compensat ion in case of difference to be determined by arbi t ra t ion or act ion a t law a t the election of t he par ty aggr ieved : Provided t h a t the Council m a y in all cases be a t l iber ty to set u p by way of defence or in mi t igat ion of' damages , as t he case may he, t h a t the person c la iming compensat ion

has by his own act, neglect , or default caused or cont r ibuted to the damages in respect of which he claims to he compensated.

20. The Governor may make regulat ions to he observed dur ing the construct ion, al terat ion, repair or ma in tenance of works for securing the safety of persons and private or publ ic proper ty from in ju ry from lire or otherwise, and may in those regula t ions impose any pena l ty not exceeding one hund red pounds for a n y breach of the same, which penal t ies m a y he recovered in a summary way before a n y s t ipendiary magis t ra te .

2 1 . The Council may from t ime to t ime enter into any contract

w i th any person for supplying wi th electricity any place or bui ld ing, or for providing any person wi th electric lines, burners , meters , l amps , or other fittings and th ings , and for t he repair thereof in such m a n n e r and upon such t e rms as to charges, place, and mode of paymen t and otherwise in securi ty of the Council as shall be agreed upon .

22. The Counci l m a y let any meter for ascer taining the

q uan t i t y of electricity consumed or supplied and a n y fittings there to for such remunera t ion , and on such t e rms in respect of the repair of such mete r and fittings, and for secur ing the safety and r e tu rn thereof

23. The Council shall do all th ings reasonable to keep all mete rs on hi re to any consumer in proper order for correctly regis ter ing t h e quan t i t y of electrici ty supplied, and in default of t he Counci l so doing the consumer shall no t be liable to pay r emunera t ion for t he use of t h e same dur ing such t ime as such defaul t cont inues .

24. Eve ry mete r used for ascer ta in ing the quan t i t y of electr ici ty

supplied by t h e Counci l shall, du r ing t h e con t inuance of such supply and u n t i l all charges in respect thereof have been paid, be unde r t h e sole control of t h e Council , whe the r such me te r be t h e p rope r ty of t he Council or not , a n d no person shal l be a t l iber ty to cut , connect , t ap , fix, al ter , remove, or t ampe r wi th any electric l ine, l amp , meter , or f i t t ings used in connect ion wi th t he supply of electr ici ty by the Counci l unless authorised in wr i t ing by the Council or i ts agents duly au thor ised in t h a t behalf : Provided t h a t n o t h i n g in th i s section shall affect t h e lawful exercise of any power in t h a t behalf vested in any compe ten t

person or publ ic au thor i ty .
25. The register of t he me te r used for ascer ta in ing the q u a n t i t y
of electr ici ty supplied by the Council shall be prima facie evidence of
such quan t i ty .

20. The Council shall not be ent i t led to prescribe a n y special
form of l a m p or bu rne r to be used by any person, or in any way to

control or in terfere wi th t h e m a n n e r in which electricity sujiplied b y

i t in pur suance of th is Act is used : Provided always t h a t no person

shall be a t l iber ty to use any form of l a m p or bu rne r , or to use t h e electr ici ty supplied to h im for any purposes, or to deal wi th it in any m a n n e r so as to u n d u l y or improper ly interfere w i th t he supply of electrici ty to any other person, and if any dispute or difference as to t he m a t t e r s aforesaid arises be tween t h e Council and any person

ent i t led to be supplied wi th electrici ty in pu r suance of th i s Act , such
d ispute or difference shall be de te rmined by arbi t ra t ion.
27. W h e r e a supply of electr ici ty is provided in a n y local i ty

for p r iva te purposes, all persons w i th in such locali ty shall on appl ica­ t ion be ent i t led to a supply on the same t e rms as the te rms on which any other person in such locality is unde r similar c i rcumstances ent i t led to a corresponding supply.

28. I f any person neglect to pay any electr ic l igh t ra te , or any charge for electricity, or any o ther s u m due to t he Counci l in respect
of or inc identa l to the supply of electrici ty to such person, t h e Council
m a y wi thou t not ice cu t oil his supply of electr ici ty, and for t h a t purpose m a y cut , disconnect, or remove any works, a n d may , un t i l such charge or other sum, toge ther wi th any expenses incurred by the Council i n cu t t i ng off such supply of electr ici ty as aforesaid is fully paid, b u t no longer, discont inue t he supply of electricity to such person.
29. A n y person who unlawful ly and maliciously cu ts or in jures a n y electric l ine or work erected in pu r suance of this Act , w i th i n t en t to cu t off any supply of electricity, shal l be gui l ty of felony, and be l iable to be kep t in penal servi tude for any t e r m not exceeding th ree years, or to be imprisoned, wi th or wi thou t ha rd labour, for a n y t e r m n o t exceeding one year, b u t no th ing in th is section shall exempt a person in respect of any offence which is punishable unde r any other provision of th is Act , or u n d e r any o ther Ac t , or a t common law, so t h a t no person be punished twice for t he same offence.

30. A n y person who maliciously or f raudulen t ly abst racts ,

causes to be wasted or diverted, consumes, or uses any electr ici ty provided in pur suance of th i s Act , shal l be gui l ty of s imple la rceny

and punishable accordingly. 31.

3 1 . A n y person who wilfully and unlawful ly removes, destroys,

or damages any electric l ine or any pi l lar , post, l amp, me te r or other works connected wi th or r e la t ing to t he supply of electricity by t h e Council in pur suance of th i s Ac t , or who wilfully a n d unlawful ly ex t ingu ishes any of t he publ ic lamps or l ights main ta ined by the Council in pu r suance of this Act , or wastes, or wilfully and wrongfully uses any of t he electr ici ty supplied by the Counci l in pursuance of th i s A c t shall for each such oll'ence forfeit to the Council a sum not exceeding fifty pounds in addi t ion to t he a m o u n t of damage done.

32. A n y person who carelessly or accidently breaks , th rows down, or damages any electric line, or any pil lar , post, l amp or other works be longing to t he Council , or unde r thei r control , shall forfeit and pay such s u m of money by way of satisfaction to t he Council for t he damage done not exceeding fifty pounds as a s t ipendiary magis t ra te shall t h i n k reasonable : Provided tha t this section shall not effect any other remedy.
33 . Any 'pe r son who wilfully or f raudulent ly , or by culpable negl igence, injures or suffers to be injured, any electric line, or any meter , fittings, or works be longing to the Council, or al ters t he index to any mete r , or prevents any me te r from duly regis ter ing the quant i ty of electr ici ty supplied, or f raudulent ly abstracts , consumes, or uses electr ici ty supplied by the Council , shall , wi thou t prejudice to any other r i g h t or remedy for the protect ion of t he Council , or t he punish­ m e n t of the offender, for every such offence, forfeit to t h e Council a sum not exceeding twenty-f ive pounds in addit ion to t he a m o u n t of damage .

3 1 . I n any case in which any person has been convicted of

wilfully or f raudulent ly in jur ing , or suffering to be injured, any electric l ine, or any meter , fittings, or works be longing to t he Council , or a l te r ing t h e index to any meter , or p reven t ing any me te r from duly

regis ter ing the quan t i t y of electricity supplied, t h e Council may also,

u n t i l t h e m a t t e r complained of has been remedied, b u t no longer , discont inue the supply of electricity to the person so offending, not­

wi ths t and ing any cont rac t previously exist ing.

35. The existence of artificial means for causing such a l tera t ion or prevent ion, or for abs t rac t ing , consuming , or us ing electricity supplied by t h e Counci l when the me te r is unde r t he custody or control of the consumer, shal l be prima facie evidence t h a t such al terat ion, prevent ion, abst ract ion, or consumption (as t he case m a y be) was wi th in t he knowledge of t h e consumer.

3G. A n y officer appointed by the Council in t h a t behalf may , a t all reasonable t imes, enter any place or bui ld ing to which electrici ty is or lias been supplied by the Counci l in pu r suance of this Ac t for the purpose of inspect ing and tes t ing t he electric lines, meters , accumula tors , fittings, appara tus , a n d works for t he supply of electrici ty belonging to t he Council , and of ascer ta ining the q u a n t i t y of electricity consumed or supplied, or, where a supply of electricity is no longer required, or where t h e Council is author ised to t ake away and cu t off the supply of electr ici ty from any premises, for t he purpose of removing any electric lines, accumula tors , fittings, appara tus , or works belonging to the Council , and repa i r ing all damage caused by such en t ry , inspection,

or removal .
37. W h e r e any electric lines, meters , accumula tors , fittings,

appa ra tu s , or works be longing to t he Council a rc placed in or upon a n y place or bu i ld ing (not be ing in t he possession of t he Council) for t h e purpose of supply ing electrici ty in pursuance of this Act , such electr ic lines, meters , accumula tors , fittings, appara tus , or works shall no t be subject to distress or to the landlord 's remedy for r e n t of t he premises where t h e same may be, nor to be t a k e n in execut ion

unde r

under any process of a Court of law or equi ty , or any proceedings in b a n k r u p t c y against t h e person in whose possession the same m a y be :

Provided t h a t n o t h i n g in th is section shall affect any distress or

execut ion lawfully made or issued upon or agains t t he Council .

38 . Al l act ions or o ther proceedings against t h e Council , the i r

officers, agents , or servants , for a n y t h i n g done or reasonably supposed to have been done in pu r suance of this Act , shall be commenced wi th in twelve months after t he ma t t e r complained of was commi t t ed and not o the rwise ; and notice in wr i t ing of any such act ion or proceedings and of t he cause thereof shall be given to the defendant one m o n t h a t least before t he commencemen t of t he p roceed ing ; and in every such proceeding the defendant may plead t h e general issue and give th is A c t and the special m a t t e r in evidence a t any tr ial to be had there ­ upon ; and no plaintiff shall recover in any such proceeding if t ender of such sufficient amends shal l have been made before t h e same was commenced, or if a sufficient sum of money shall have been paid in to a Cour t after such commencemen t by or on behalf of the defendant , toge ther wi th costs as be tween pa r ty and par ty incurred u p to t h a t t ime . A n d if a verdict shall be entered for tin; defendant , or t h e plaintiff shall become non-sui t or d iscont inue such proceeding, or if upon demurre r or otherwise j u d g m e n t shall be given against t he plaintiff, t h e defendant shall recover his costs and have t h e like r emedy for the same as any defendant has in law in like cases.

39. A n y arbi t ra t ion in pursuance of this Ac t shall ba conducted in accordance wi th and subject To the provisions of the Arb i t ra t ion A c t of 1892, and for t he purposes of reference to arbi t ra t ion there ­ under this A c t shal l be deemed to be a submission between the par t ies wi th in the mean ing of the same. The arbi t ra tor shall in every case have power to direct how and by w h o m the cost of the reference and award shall be paid.
40. Wheneve r by any section of this Ac t any person is made, liable to any fine or forfeiture or to pay any sum of money whe the r as compensat ion or in any other way, and the mode of recovering such fine, forfeiture, or sum is no t specified t he same m a y be recovered before any s t ipendiary magis t ra te , toge ther wi th such costs as he m a y see fit to grant . And all sums of money ordered by any such magis t ra te to be paid, and all costs and expenses awarded by such mag i s t r a t e may be recovered and enforced by distress and sale of t he goods and chat te ls of t h e person ordered to pay the same, and in default of sufficient

distress such person shall be liable, in the event of the convict ion being for an offence unde r this Act , to be imprisoned wi th or wi thou t
ha rd labour for any t e rm not exceeding three mon ths unless such
money, costs, or expense's he sooner p a i d : Provided t h a t no th ing in th is section shall p reven t proceedings for t he recovery of any tine, forfeiture, or s u m as aforesaid be ing t aken in any other Court of competent jur isdict ion when the amoun t sought to be recovered exceeds

t e n pounds .

4 1 . Al l fines, forfeitures, or other sums recovered by the

Counci l in pursuance of this A c t shall be carried to the credit of t h e

electric l igh t account .

42. I n any case in which any s u m m a r y conviction has been had, or any order for t he paymen t of money has been mr.de, in pur­ suance of this Act before any s t ipendiary magis t ra te the; defendant m a y appeal to t he Cour t of Qua r t e r Sessions. The provisions of the

" Cr iminal L a w A m e n d m e n t Act of 1 8 8 3 " in respect of appeals from

s u m m a r y convictions the reunder shall apply and ex t end to all appeals unde r this section, and shall be observed in the m a k i n g of every such appeal and all proceedings thereupon .

4 3 . The Counci l may for the purposes of th is Act , b u t subject

never theless 1o any regulat ions made by the Governor as here in provided, m a k e all such by- laws, and do all such o ther necessary ma t t e r s and th ings as m a y be necessary for car ry ing out the objects of this Ac t . A n d t h e Council, may by any such by-laws fix t he m a x i m u m pena l ty for every offence agains t such by-laws or any of

1 hem, no t exceeding the penal ty , if any, a lready lawfully fixed for
Hie same offence, and in any other case not exceeding ten p o u n d s : Provided tha t no by-laws made as aforesaid shall have any force unless they have been first approved of by the Governor .
44. I t shal l be lawful for t he Council to supply electr ici ty outside the l imits of the City of Sydney, and for such purpose to exercise; any power conferred upon it by this Ac t (other t h a n the power to raise a l igh t ing rale) within or wi thout the l imits of any Borough adjoining the City of Sydney, subject, however, to the following provisions :—

(i)   The aforesaid powers shall not be exercised within the limits of any such Borough except wi th t h e consent of t he Council thereof (which consent it is hereby empowered to give), and upon such t e rms and conditions as may be mu tua l l y agreed upon.

(n) The supply of electricity for the purpose of lighting any

place, bui ld ing, or street be longing to or subjec t to the control of the Council of such Borough shall for the pur­ poses of this A c t be deemed to be a supply for pr ivate purposes or use, and all provisions of this A c t in such behalf shall ex tend and apply thereto .

( I I I ) The Council of such Borough shall for the purposes of ibis section have power to enter into all such contracts , and to levy all such rates, as it is by law empowered to enter into, or levy in respect ol' a supply of gas.

45 . No th ing in this Act shall author ise or enable the Council , its officers, agents , or servants to t r ansmi t any te legram, or te lephonic message, or to per form any of the inc identa l services of receiving, collecting, or del ivering te legrams , or te lephonic messages, or give to the Council , its officers, agents , or servants any power, au thor i ty , or facility of any k ind whatever in connect ion wi th such t ransmiss ion or performance as aforesaid. A n y person hold ing any civic office t inder the " S y d n e y Corporation Ac t of 1 8 7 9 " is hereby empowered to contract direct ly or indirectly for t he supply to h i m of electricity
unde r the provisions of this Act , and shall no t be liable in respect of
such cont rac t to any fine, penal ty , or disqualification, any A c t to the

contrary no twi ths tanding .
f(i. N o a l tera t ion in any te legraphic l ine or te lephonic l ine or

work of the; Pos tmas te r -Genera l shall be m a d e by the Council or its agents , except w i th the wr i t t en permission of t h e Pos tmas te r -Genera l , or in any other publ ic work except wi th the wr i t t en permission of the Secretary for Pub l i c W o r k s , and subject to such reasonable conditions as may bo imposed in such permission. A n d no th ing in this A c t conta ined shal l exempt t he Council from the provisions of any publ ic Ac t which may be passed by the Pa r l i amen t of N e w South Wales , applying general ly to the manufac tu re or genera t ing of electr ici ty, or the sale or supply of the same, or to the method of ins ta l la t ion or

distr ibution thereof.
