No. 35 of 1925.
AN ACT to amend the Municipal Corporations Act, 1906,
so far as relates to the Municipality of York.
[Assented to 31st December, 1925.]
BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative
Council and Legislative Assembly of Western Australia, in
this present Parliament assembled, and by the authority of
the same, as follows :—

(1) Whenever any street or way is not re- quired as a public thoroughfare, and the closing thereof will cause no inconvenience to the public, the Governor may, on the application of the Council, temporarily close such street or way for such time as may be deemed expedient. |

(2) Before any such street or way is closed as aforesaid, notice of the application of the Council for such closure, and the reasons for the making thereof, shall be published in the Gcmernment Gazette and in a newspaper circulating in the municipality within which such street or way is situated, once in each week for four consecutive weeks, stating the situation of the street or way and the period for which it is proposed to close the same.

(3) The Council shall serve a copy of such notice on the owners and occupiers of all land abutting on the street or way with a notification endorsed thereon that if the application is objected to, notice of such objection must be given to the Minister within one month from a date to be stated in such endorse- ment.
(4) Whenever a street or way has been closed in accordance with this section, the street or way shall be deemed to be land vested in or acquired by the Council during the period of closure, and may be leased under and subject to the provisions of Part IX. of this Act.
3. This Act shall only have effect within the bound-
aries of the Municipality of York.
