AFFAIRS COMMISSION

AMENDMENT ACT

No. 27 of 1986

AN ACT to amend the Multicultural and Ethnic Affairs Com-

mission Act 1983.

[Assented to 29 July 1986.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the

advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. This Act may be cited as the Multicultural and Ethnic Affairs

Commission Amendment Act 1986.

Commencement

2. This Act shall come into operation on the day on which it receives

the Royal Assent.

Principal Act

3. In this Act the Multicultural and Ethnic Affairs Commission Act

1983* is referred to as the principal Act.

Section 3 amended

4. Section 3 of the principal Act is amended

(a) by inserting after the definition of "Commissioner" the follow- ing definition

"Deputy Commissioner" means the person appointed to be Deputy Commissioner for Multicultural and Ethnic Af- fairs under section 7; ";

(b) in the definition of "member" by inserting after

"Commissioner" the following-

" and the Deputy Commissioner "; and

(c) by deleting the definition of "section".

Section 6 amended

5. Section 6 of the principal Act is amended in subsection (1)-

(a) by deleting "11" and substituting the following-

" 12 "; and

(b) by inserting after paragraph (a) the following paragraph-

" (aa) the Deputy Commissioner; ".

Section 7 amended

6. Section 7 of the principal Act is amended

(a) in subsection (1) by inserting after "Affairs" the following-

" and a person to be Deputy Commissioner for Multicultural

and Ethnic Affairs ";

(b) in subsection (2) by deleting "The" before "Commissioner" and substituting the following-

" Each of the Commissioner and the Deputy ";

(c) in subsection (3) by deleting "is" and substituting the follow- ing

" and the Deputy Commissioner are "; and

(d) in subsection (4) by inserting after "Commissioner"—

(i)   in the first place where it occurs, the following-

" or the Deputy Commissioner "; and

(ii)   in the second and third places where it occurs, the follow- ing

" or Deputy Commissioner ".

Section 8 amended

7.     Section 8 of the principal Act is amended in each of subsections (1)

and (2) by inserting after "Commissioner" the following-

" or the Deputy Commissioner ".

Section 12 amended

8.     Section 12 of the principal Act is amended

(a) in subsection (2) by inserting after "Commissioner" the follow- ing

" or, in the event of the Commissioner being absent or for any

other reason unable to act, the Deputy Commissioner ";

(b) in subsection (3) by inserting after "present" the following

and the Deputy Commissioner shall preside at all meetings of the Commission at which he is, but the Commissioner is

not, present "; and

(c) in subsection (4) by deleting "is" and substituting the follow-

ing

" and the Deputy Commissioner are both ".
