MULLEWA ROAD BOARD LOAN RATE.

No. 2 of 1938.

AN ACT to authorise the Mullewa Road Board to levy a certain loan rate upon rateable land within a portion only of the Mullewa Road District and to validate such loan rate as already levied in respect of rateable land within such portion of the said district.

[Assented to 25th October, 1938.1

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

Short title.

1. This Act may be cited as the Mullewa Road Board Loan Rate Act, 1938.

The notice of a proposal by the Mullewa Road Board to borrow twelve hundred pounds for the pur- pose of certain works as therein specified as published

in the Government Gazette on the twenty-sixth day of

November, one thousand nine hundred and thirty-seven, shall be deemed to include and to have included as from the issue for publication of such notice, within the mean- ing and for the purposes of section two hundred and forty-five of the Road Districts Act, 1919-1933, a notifi- cation that in the opinion of the said Mullewa Road Board the said works were likely to benefit, do benefit or will benefit only that portion of the Mullewa Road District known as the central ward, more particularly described in the schedule to this Act.

The loan rate in respect of the loan to which the proposal aforesaid relates struck by the said Board on the ninth day of July, one thousand nine hundred and thirty-eight, and made and levied or purporting to be made and levied under the provisions of section two hundred and forty-five of the Road Districts Act, 1919-1933, on the annual rental value of all rateable land in that portion only of the Mullewa Road District known as the central ward aforesaid shall be deemed to have been lawfully made and levied and all things necessary to be done in and towards the making and levying of such rates shall be deemed to have been duly performed notwithstanding any defect or omission in the notice referred to in section two of this Act or any failure to comply with the provisions of section two hundred and forty-five or of any other section of the Road Districts Act, 1919-1933, relating thereto, and the said rates may be recovered by the said Board as if the provisions of the said Act were in all respects duly complied with.

SCHEDULE.

M[LLEWA ROAD DISTRICT.

Central Ward.—All that portion of the Mullewa Road District bounded on the westward and northward by lines commencing on the eastern side of Forrest road at the south-west corner of Mullewa Sub- lot 20, and extending northward along said side of the road to the pro- longation south-eastward of the south-western boundary of Sub-lot 26; thence along said prolongation and south-western boundary to the west corner of Lot 26 aforesaid; thence north-westward to the south-east corner of Mullewa A.A. Lot 22 and northward along the east boundaries of Lots 22 and 23, part of the south boundary of Lot 27 to the west boundary of Victoria Location 1675 and along part of the west and the

north boundary of same, part of the west boundary of Location 2029, the southern and the east boundaries of A.A. Lot 36, the east boun- daries of Lots 37 and 38 and the north boundary of Location 4379 to its north-east corner.

On the eastward by lines commencing at the aforesaid north-east corner and extending southward along the east boundaries of said Location 4379 and of Location 7386 and A.A. Lot 6 to the south-east corner of the lattermost.

On the southward by lines commencing at the said south-east corner and extending westward along the south boundaries of Lots 6, 5 and 4, part of the west boundary of Lot 8, the north boundary of Lot 1 and its production westward to the starting point.
