GLEESON CJ:   This appeal was heard in Canberra on 11 and 12 February 2004 by a Court constituted by Justices McHugh, Gummow, Kirby, Hayne, Callinan, Heydon and myself.  The Court is now in a position to announce its orders in the matter.  At least a majority of the Court is of the opinion that the appeal should be dismissed with costs.

The order of the Court is the appeal is dismissed with costs.  I publish that order.  The Court will publish its reasons for judgment at a later date.
