Mudgee Hospital Site Act 1873 No 8a (NSW)
No. XIII.
An Act to authorize the sale of the site of the Mudgee Hospital and to provide for the acquisition of a new site for the said Hospital and for the erection of suitable
buildings thereon. [26th March, 1873.]
WHEREAS by a deed of grant under the hand of Sir William Thomas Denison dated the eighth day of January one thousand eight hundred and fifty-eight a portion of land containing by admeasure- ment two acres more or less situate in the town of Mudgee and more particularly described in the Schedule hereto was granted unto Robert Lowe Donald Rankin Macdonald and George Henry Cox and to their heirs and assigns as a site for a public hospital in the said town upon the trusts in the said deed of grant declared And whereas the build- ings erected on the said land are inadequate and unfit for the require- ments of the district and the site has become unsuitable for the purposes of a public hospital And whereas it is expedient that provision should be made for the acquisition of a better site and for the erection thereon of suitable buildings for such hospital And
that the Trustees for the time-being of the said land should be empowered to sell and dispose of the same in order to raise a sum of money to be expended in defraying part of the cost of purchasing
a new site and of erecting thereon suitable buildings for the said hospital Re it therefore enacted by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled and by the authority of the same as follows :—
1. It shall be lawful for the Trustees for the time-being of the said Mudgee Hospital to sell and dispose of the said parcel of land described in the Schedule hereto by public auction or private contract and either in one lot or in several lots as they shall deem expedient
for
for such price or prices as can he reasonably had or obtained for the same and to convey and assure the same or any portion or portions thereof when sold to the purchaser or purchasers thereof in fee simple freed and discharged from all trusts affecting the said land And the receipt in writing of the said Trustees for the purchase moneys arising from such sale or sales shall be a sufficient discharge to any and every purchaser of the said land or portions thereof and exonerate such purchaser from seeing to the application of the said moneys and from
all liability in respect of the misapplication or non-application thereof.
2. The said Trustees their heirs or assigns shall stand possessed of the moneys arising from such sale or sales as aforesaid upon trust to apply the proceeds thereof in or towards the erection maintenance and support of a public hospital in the town of or in the vicinity of the town of Mudgee and in or towards the purchase of a suitable site for that purpose And the said Trustees their heirs or assigns shall also stand possessed of any moneys voted or to be voted by Parlia- ment in aid of the said hospital upon the like trusts as are hereinbefore declared in respect of the proceeds of sale of the said land And the receipts of any person or persons to whom any moneys shall be paid by the said Trustees their heirs or assigns under the provisions of this Act shall be a valid and complete discharge to the said Trustees their heirs or assigns for such moneys.
3. No purchase of any land as a site for the said hospital shall be lawful unless the same shall have been approved by the Governor with the advice of the Executive Council And all buildings offices and their appurtenances to be erected on the land so purchased shall be constructed according to plans and specifications to be approved of by the Colonial Architect.

same more or less situated in the county of Wellington parish of Mudgee and town of
Mudgee allotments number one (wo three and four of section number eighteen Com-

| angles to Perry-street bearing west four chains dividing it from allotments numbers twenty nineteen eighteen and seventeen On the west by a line at right angles to the southern boundary bearing north five chains dividing it from allotment number five and on the north by the south side of Mortimer-street bearing east four chains to the north- east corner aforesaid.
