1. The applicant seeks the removal to this Court, under s 40 of the Judiciary Act 1903 (Cth), of a pending proceeding in the District Court of Western Australia. No proper basis for removal has been identified and, in any event, it is inappropriate in this matter to fragment the ordinary judicial process by an order for removal.

2. Pursuant to r 26.07.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
