Unfair dismissal.

[1] On 4 March 2010, Mr William Mayes (“the Applicant”) made application to Fair Work Australia seeking a remedy for unfair dismissal from his employment at Ocean Four Pty Ltd t/as Cuddles Childcare Centre Rivervale (“the Employer”).

[2] Mr Mayes has made the application pursuant to s.394 of the Fair Work Act 2009 (“the Act”).

[3] The application was unable to be settled in conciliation and subsequently referred to me for arbitration.

[4] The matter was set down for hearing on 19 April 2010.

[5] Following the opening submission by the Applicant’s representative, and prior to evidence to be given by the Applicant, the Employer advised that it was willing to explore resolution of the matter without the hearing continuing.

[6] With the consent of both parties, the matter moved into conciliation facilitated by the Tribunal.

[7] At the conclusion of conciliation, the Applicant and Respondent agreed for the matter to be resolved by way of orders to be issued by the Tribunal with the consent of both the Applicant and the Respondent.

[8] The Order in the agreed terms is issued.
