Application for unfair dismissal remedy - Arbitration - Remedy - Amount of compensation.

[1] In a decision released on 30 September 2013, I found that Mr Thomas Courtney had been unfairly dismissed by Coal Gas Camps Pty Ltd 1. I decided that Mr Courtney should be paid an amount of compensation of $8,400.00 for the full roster cycle he was working at the time of his dismissal and that the amount of payments made to Mr Courtney for work on that cycle at the point he was dismissed should be deducted.

[2] The parties did not provide evidence upon which the amount of compensation could be calculated. Directions were issued requiring them to file and serve further material in relation to these matters.

[3] Coal Gas Camps Pty Ltd provided a statement indicating that at the time of his dismissal, Mr Courtney was working a fourteen day roster cycle from 7 to 20 January 2013, and that on termination of his employment, Mr Courtney was paid the amount of $6,862.50.

[4] The statement provided by the Company has been forwarded to Mr Courtney in accordance with the Directions. Mr Courtney agreed with the calculation provided by the Company.

[5] Accordingly, I accept the information provided by Coal Gas Camps Pty Ltd, and determine that Mr Courtney’s compensation in accordance with my decision of 30 September 2013, is $2,125.00, less taxation as required by law.

[6] An Order requiring that this amount be paid to Mr Courtney will issue with this Decision.
