Application for order for production of documents - order opposed - amended order issued
[1] Mr Saksham Pabbi has made an application pursuant to s.394 of the Fair Work Act 2009 (the Act), alleging that he has been unfairly dismissed by his employer. 1 The application is listed for an arbitrated hearing to be held on 16 December 2020. Subsequent to this listing, an application for an order for production of documents has been made by Mata Sherawali and Guru Nanak Pty Ltd.
[2] The application was opposed by the applicant and the application for production of documents was heard before the Commission at which both parties were granted leave to be represented by a paid agent for the applicant and legal representation for Mata Sherawali and Guru Nanak Pty Ltd pursuant to s.596(2)(a) of the Act.
[3] The application, as required under the Commission’s Rules 2 included a draft order. The Commission, having heard the submissions of the parties determined to grant the order with some amendments with respect to both categories of documents sought and the return date. The reasons for granting the order with the amendments was advised to the parties during the hearing.
[4] The Order sought, as amended, has been dispatched to the parties. The documents to be produced are in the attached schedule to the Order.
