Application for an unfair dismissal remedy, consent.

[1] This matter is an application made by Mr Peter Haggitt (the Applicant) alleging that his previous employer, Lenspro Australia Pty Ltd (the Respondent) terminated his employment in circumstances which were unfair.

[2] The application was filed in Fair Work Australia (FWA) on 11 January 2012. An employer response was filed with FWA on 6 February 2012 by the Respondent. The parties participated in a telephone conciliation conference on 9 February 2012. The parties were unable to resolve the matter and accordingly, it was referred for arbitration.

[3] On 22 June 2012, the Respondent filed an F4 Objection to Application for Unfair Dismissal Remedy form on the basis that the application is frivolous and vexatious.

[4] Both matters were set down to be heard on 2 and 3 July 2012.

[5] On 2 July 2012 the matter adjourned to conciliation after initial submissions. The parties agreed to settle the matter, pursuant to a deed of settlement signed by the parties on 2 July. A copy of this deed has been retained on the file.

[6] A Consent Order that gives effect to this deed of settlement is issued in conjunction with this decision (PR525832).
