Application for unfair dismissal remedy

[1] This is an application pursuant to s.394 of the Fair Work Act 2009 (the Act) by Nigel Leahy (the applicant) alleging that his termination of employment by Rosetta Plumbing Pty Ltd (the respondent) was unfair.

[2] Directions were issued 6 October, 2011. The respondent complied with the Directions. There was no compliance by the applicant.

[3] The file records that attempts to contact the applicant have been unsuccessful.

[4] The matter was listed in Hobart for hearing a jurisdiction argument by the respondent on 5 December, 2011.

[5] There was no attendance by the applicant and attempts to contact him were again unsuccessful.

[6] Accordingly a decision was issued in transcript dismissing the application for want of prosecution.
