(C2023/7535)

COMMISSIONER LEE

MELBOURNE, 29 MAY 2024

Application to deal with contraventions involving dismissal – confidentiality order.

  1. Mr Michael Spiegel (the Applicant) made a s.365 application to deal with contraventions involving dismissal to the Fair Work Commission (the Commission) on 1 December 2023. The matter was allocated to me for consideration on 19 December 2023.

  1. Further to a conference between the above parties on 23 February 2024, and the terms of a settlement agreement between them, the parties jointly sought an order from the Commission that it redact or otherwise mark as confidential paragraphs 20 to 30 inclusive of the Form F8 - general protections application involving dismissal which, was filed on 1 December 2023 in respect of the above matter.

  1. I am satisfied that it is desirable to make the order sought to ensure that the information that the Respondents say is subject to legal professional privilege is not inadvertently waived. I will issue an order[1] to that effect separately.

CaseChat Overview and Summary

In the matter of Mr Michael Spiegel v The Florey Institute of Neuroscience and Mental Health, Trevor Kilpatrick, the applicant sought to address contraventions involving dismissal under section 365 of the Fair Work Act 2009. This application was filed with the Fair Work Commission on 1 December 2023, and subsequently allocated to Commissioner Lee for consideration. The case revolves around an application to ensure that specific information within the application is treated as confidential and marked appropriately, as per a settlement agreement reached between the parties. The application primarily focuses on the confidentiality of certain details within the original application, specifically paragraphs 20 to 30 of the Form F8.

The legal issues before the court involved the interpretation and application of the Fair Work Act 2009, specifically concerning section 365, which deals with the procedures for dealing with contraventions involving dismissal. The primary issue was whether the Commission should redact or mark as confidential certain paragraphs of the applicant’s Form F8 application. This decision was necessitated by the settlement agreement between the applicant and the respondents, who sought to protect information they claimed was subject to legal professional privilege.

The court considered the implications of maintaining confidentiality in the context of the settlement agreement and the potential waiver of legal professional privilege. It was determined that issuing the order to redact or mark the specified paragraphs as confidential would be in the best interest of protecting the sensitive information as per the settlement terms. Commissioner Lee concluded that the order should be made to prevent any inadvertent disclosure of the privileged information.

The court issued an order, PR774488, to redact or mark as confidential paragraphs 20 to 30 of the Form F8 application filed by Mr Michael Spiegel. This order ensures that the sensitive information, as agreed upon by the parties, is appropriately protected, and the integrity of the legal professional privilege is maintained.
