Application to deal with contraventions involving dismissal – confidentiality order.

  1. Mr Michael Spiegel (the Applicant) made a s.365 application to deal with contraventions involving dismissal to the Fair Work Commission (the Commission) on 1 December 2023. The matter was allocated to me for consideration on 19 December 2023.

  1. Further to a conference between the above parties on 23 February 2024, and the terms of a settlement agreement between them, the parties jointly sought an order from the Commission that it redact or otherwise mark as confidential paragraphs 20 to 30 inclusive of the Form F8 - general protections application involving dismissal which, was filed on 1 December 2023 in respect of the above matter.

  1. I am satisfied that it is desirable to make the order sought to ensure that the information that the Respondents say is subject to legal professional privilege is not inadvertently waived. I will issue an order[1] to that effect separately.
