Application for relief from unfair dismissal.
[1] This matter involves an application for unfair dismissal remedy made pursuant to section 394 of the Fair Work Act 2009 (the Act). The application was lodged at Sydney on 20 February 2014. The application was made by Luke Crighton (the applicant) and the respondent has been identified as Snapper Road Seafoods Pty Ltd T/A Snapper Road (the employer).
[2] The matter was listed for Directions before the Fair Work Commission (the Commission) on 28 May 2014, in order for the matter to be programmed for an Arbitration Hearing. The applicant failed to attend these proceedings and failed to provide the Commission with any other written advice in relation to this matter, despite the Commission requesting the applicant to do so.
[3] On 5 June 2014, the Commission further requested that the applicant provide a written communication regarding the matter within seven days. The Commission advised that in the absence of any communication from the applicant, the Commission would then of its own motion, move to dismiss the matter.
[4] As of 16 June 2014, the Commission has not received any written communication from the applicant, or any other advice about this application. Therefore pursuant to s.587 of the Act, the application is dismissed for want of prosecution.
[5] An Order [PR552057] dismissing the matter will be issued concurrently with this Decision.
