Application to deal with contraventions involving dismissal

  1. Mr Jason Mercer (Applicant) made an application under s.365 of the Fair Work Act 2009 (Act) to deal with contraventions involving dismissal. In their response Tasmanian Ports Corporation Pty Ltd (Respondent) raised a jurisdictional objection that the Applicant was not dismissed within the meaning of s.386(1) of the Act.

  1. At a Mention Hearing on Monday, 13 May 2024 and for the reasons given on the transcript, I dismissed the jurisdictional objection that the Applicant was not dismissed. I then conducted a private conference to deal with the dispute pursuant to s.365 of the Act. The Commission has now concluded its role in relation to this matter.
