Application for relief from unfair dismissal.

[1] This decision relates to an unfair dismissal application by Mr Douglas Sands pursuant to s.394 of the Fair Work Act 2009 (Cth) (the Act) against his former employer, Kukas Brothers Pty Ltd as trustee for the Kukas Brothers Unit Trust.

[2] Despite repeated attempts to have the applicant provide information as to whether he wishes to pursue his application, or file a Notice of Discontinuance, he has not done so. On 1 March 2016, the applicant was advised that if he did not make contact with our chambers by 15 March 2016, the Commission would move to dismiss the matter. Unfortunately the Commission has still not received any communication from the applicant.

[3] Therefore, pursuant to s.587(1) of the Act, the application is dismissed.
