Appeal against decision [2017] FWC 1652 of Deputy President Binet at Perth on 21 July 2017 in matter number U2016/10836; appeal upheld by consent; decision quashed; matter remitted to Deputy President Binet.
[1] Further to our decision in [2017] FWCFB 4558 (Decision) and by consent of the parties, we have determined to uphold the appeal on the basis that there was a denial of procedural fairness for reasons and in the circumstances set out at [11] – [13] of our Decision.
[2] We therefore:
(a) uphold the appeal;
(b) quash the decision in [2017] FWC 1652; and
(c) remit the matter to Deputy President Binet.
