1. The applicant seeks special leave to appeal from a judgment of the Federal Circuit and Family Court of Australia (Division 1) Appellate Jurisdiction (Aldridge, Jarrett and Strum JJ) dismissing an appeal from the Federal Circuit and Family Court of Australia (Division 1) (Christie J) whereby the competency of the first respondent in bringing proceedings under s 79A of the Family Law Act1975 (Cth) was contended. The proposed appeal has insufficient prospects of success to warrant a grant of special leave to appeal.

2. Special leave to appeal is refused with costs.
