[1] An application has been made by the respondent to set aside the order made by Fair Work Australia (FWA) on 22 January 2010 that the respondent produce to FWA specified documents.
[2] I have considered the written submissions of the respondent and the reply submissions of the applicant.
[3] I dismiss the respondent’s application.
[4] I will however amend the Order issued on 22 January 2010 to provide that the respondent must comply with the order by 10.00am on 9 February 2010.
[5] Production of documents required by an Order issued under s.590 is production of documents to FWA. Access to those documents by a party to a proceeding is not automatic but is at the discretion of FWA.
[6] The applicant or his legal representatives are to be given access to the documents required to be produced to FWA and which are referred to in paragraphs 1, 2, 4 and 5 of the Schedule to the Order issued on 22 January 2010.
[7] The applicant or his legal representatives are not to be given access to the documents required to be produced to FWA and which are referred to in paragraph 3 of the Schedule to the Order issued on 22 January 2010.
