F~ :~ ~ ~~ T >[ASSENTED TO 7TH NOVEMBER, 1921.] l3 E it enacted by the King's Most Excellent Majesty, _ by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, us follows:- 1. This Act may be cited as "'The Mount Mulligan Short title Relief Funds Act of '1921." 2. The Governor in Council may from time to time Appoint. appoint such and so many persons as he thinks fit to be ~ : : s\ ~ : s. the Trustees of all funds raised or to be raised for or in respect of the benefit or relief of the dependants of victims of the recent explosion in the Mount Mulligan Coal Mine, and may appoint one of such persons to be Chairman of such Trustees. 3. (1.) All moneys or other property of any kind paid, Vesting of delivered, or conveyed to or received by or purporting ~:;erty in to have been so paid, delivered, conveyed, or received Trustees. by any person, whether before, or after the passing of this Act, for or in connection with anv fund or funds raised or being raised or purporting ~ o to be for or in respect of the benefit or relief of such dependants, whether such moneys are or have been so paid, delivered, conveyed, or received by way of voluntary contribution, or as a consideration for admission to any entertainment, or otherwise howsoever, shall forthwith upon such payment, delivery, conveyance, or r:eceipt become the property of and vest in the Trustees, and every person to whom such moneys or other property are or have been so paid, delivered, or conveyed, or by whom such moneys or property have been so received, 'shall forthwith upon the passing of this Act, or forthwith after such payment deliyery conveyance or receipt, pay deliver conveyor otherwise dispose of such money or other property to the Trustees, or as such Trustees shall direct.
9812 MINING. Mount Mulligan Relief Funds Act. 12 GEO. V. No. 17, 1921. Recovery of (2.) All moneys or other property so vested in such psurochrerty. Trustees may be recovered by the Chairman of such Trustees in any· court of competent jurisdiction by proceedings in his official name of "The Chairman of Trustees of Mount Mulligan Relief Funds." Disposal of 4. (1.) All funds or other property from time to funds. time vested in such Trustees shall be held and disposed of by them for the purposes of the benefit or relief of the depend~ nts of .victims of the recent explosion in the . Mount Mulligan Coal Mine and not otherwise. Audit. (2.) Every such fund shall be audited from time to time by the Auditor-General or some officer of his depart- ment, and for that purpose the Trustees and every person having the possession, custody, or control of any such fund or of any such money or property as aforesaid shall be deemed to be a public accountant within the meaning of *" The Audit Act 0/ 1874." Penalty. 5. Any person who acts in contravention of or fails to comply with any of the provisions of this Act shall be liable to a penalty not exceeding one hundred pounds, to be recovered in a summary way by complaint under t" The Justices Acts, 1886 to 1909." Regulations 6. (1.) The Governor in Council may from time to time make all such regulations as he deems necessary for giving full and complete effect to the objects and purposes of this Act, and for securing the due and proper administration, management, and control of any such funds, money, or property, and for carrying into execution the trusts to which such funds, money, or property may be subject. . (2.) The regulations may provide for the conduct. of meetings of the Trustees and for the number that shall constitute a quorum at any such meeting. (3.) The regulations may prohibit or restrict the soliciting by any person of any contributions or aid in connection with such funds or the benefit or relief of any such dependants as aforesaid, except with the authority of the Chairman of such Trustees. * 38 Vic. MINING.-WATER SUPPLY AND SEWERAGE. 12 GEO.V. No. 28,1921. Water Supply and Sewerage Acts Amendment. 9813 (+.) The regulations may provide from time to time what persons or classes of persons shaH be regarded as dependants for the purposes of this Act. (5.) The regulations may provide a penalty not exceeding twenty pounds for any contravention thereof, to be recovered in a summary way as aforesaid. (6.) All such regulations upon publication in the Gazette shall be read as one with this Act and be of equal validity, and shall be judicially noticed. 7. The Governor in Council may, by Order in Exempt.ion Council published in the Gazette, exempt from the opera- f~;J~~am tion of this Act any fund which has already been estab- lished, if the Governor in Council is satisfied that such fund has been and will be properly and effectively administered.
