Part 1—Preliminary

1—Short title

These regulations may be cited as the Motor Vehicles Variation Regulations 2008.

2—Commencement

These regulations will come into operation on 1 March 2008.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Motor Vehicles Regulations 1996

4—Variation of Schedule 7—Demerit points

  1. Schedule 7, Part 1, Division 2, item relating to rule 266(1)—delete the item and substitute:

266(1)

Failing to ensure passengers under 16 years old are wearing seatbelts or approved child restraints

driver who is a person referred to in section 98BI(1)(a)(i) or (ii) of the Motor Vehicles Act 1959

all other drivers

see Part 2 Division 2

  1. Schedule 7, Part 2, Division 2—after item relating to rule 265(1) insert:

266(1)

Failing to ensure passengers under 16 years old are wearing seatbelts or approved child restraints

driver who is a person referred to in section 98BI(1)(a)(i) or (ii) of the Motor Vehicles Act 1959

see Part 1 Division 2

all other drivers—

failure in relation to 1 such passenger

failure in relation to more than 1 such passenger

  1. Schedule 7, Part 2, Division 3—after item relating to regulation 9A(2) insert:

26A

Failing to ensure passengers 16 years old or older are wearing seatbelts

failure in relation to 1 such passenger

failure in relation to more than 1 such passenger

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
