Part 1—Preliminary

1—Short title

These regulations may be cited as the Motor Vehicles Variation Regulations 2003.

2—Commencement

These regulations will come into operation on the day on which the Statutes Amendment (Transport Portfolio) Act 2002 comes into operation.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

4—Substitution of regulation 42

Regulation 42—delete the regulation and substitute:

42—Refund on surrender of licence

(1)Subject to this regulation, on surrender of a driver's licence or motor driving instructor's licence, the person surrendering the licence is entitled to a refund calculated by multiplying one-quarter of the annual licence fee paid by the number of complete three month periods, if any, for which the licence would have been in force after the date of surrender until the expiry of the licence.

(2)A person surrendering a licence is not entitled to a refund of a licence fee if the amount of the refund does not exceed $1.

Note—

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
