928 Motor Vehicles Safety Act Amendment Act 1990, No. 53 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Motor Vehicles Safety Act Amendment Act 1990. (2) In this Act the Motor VehiclesSafety Act1980-1989 is referred to as the Principal Act. (3) The Princ ip al Act as amended by this Act may be cited as the Motor Vehicles Safety Act 1980-1990. 2. Repeal of and new s . 38. The Principal Act is amended by repealing section 38 and substituting the following section:- "38. Approval of inspection stations . (1) The proprietor of premises may apply to the Commissioner for approval of the premises as an approved inspection station. (2) The Commissioner may, upon payment of the prescribed fee, grant approval if satisfied- (a) that an application for approval of a person as an approved examiner has been made by the proprietor and has been or is to be granted; (b) that the person approved or to be approved as an approved examiner agrees to provide services (on a full-time basis) at the premises as the employee of the proprietor or pursuant to any other arrangement made by the proprietor with either that person or a third person; and (c) that there is within the premises such equipment as is prescribed for an approved inspection station. (3) If the Commissioner grants approval, he shall issue to the proprietor of the premises a certificate of approval of the premises as an approved inspection station.". 3. Retrospective operation of section 2. A certificate of approval of premises as an approved inspection station issued on or after 1 December 1986 and before the commencement of this Act is taken to have been validly issued if the premises would have been so approved had section 38 of the Motor Vehicles Safety Act 1980-1990 (as inserted by section 2 of this Act) been in force at that time.
Motor Vehicles Safety Act Amendment Act 1990 , No. 53 929 4. Amendment of s. 41 . Cancellation and suspension of approvals. Section 41 of the Principal Act is amended in subsection (2) by omitting paragraph (a) and substituting the following paragraph:- "(a) there is no approved examiner providing services on a full-time basis at an approved inspection station or such equipment as is prescribed for an approved inspection station is not maintained therein by the proprietor;".
