Motor Vehicles (Miscellaneous) Amendment Act 2009

An Act to amend the Motor Vehicles Act 1959.

The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Motor Vehicles (Miscellaneous) Amendment Act 2009.

2—Commencement

This Act will come into operation on a day to be fixed by proclamation.

3—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Motor Vehicles Act 1959

4—Amendment of section 127A—Control of medical services and charges for medical services to injured persons

  1. (1)

    Section 127A(1), definition of prescribed limit—delete "limit prescribed for" and substitute:

    limit applying to

    Section 127A(1), definition of prescribed scale—delete "charges prescribed for" and substitute:

    charges applying to

  3. (3)

    Section 127A(2)(a)—delete "regulations" and substitute:

    scales of charges

  4. (4)

    Section 127A(4)—delete "regulations made under that Act" and substitute:

    scales of charges made

5—Amendment of section 139BD—Service and commencement of notices of disqualification

  1. (1)

    Section 139BD(3)(b)—after subparagraph (ii) insert:

    1. (iii)

      the Registrar may refuse to enter into any transaction with the person until the person pays the service fee; and

  2. (2)

    Section 139BD(5)—delete subsection (5) and substitute:

    1. (5)

      If an attempt is made to effect personal service of a notice of disqualification—

      1. (a)

        the Registrar may, if the attempt is successful, refuse to enter into any transaction with the person to whom the notice was given until the person pays the service fee prescribed by the regulations; or

      2. (b)

        the Registrar may, if the attempt is unsuccessful, refuse to enter into any transaction with the person to whom the notice is required to be given until—

        1. (i)

          the person personally acknowledges receipt of the notice in accordance with the notice; and

        2. (ii)

          the person pays the service fee prescribed by the regulations.
