579 1ttE1tslUztzbr ANNO VICESIMO QUARTO ELIZABETHAE SECUNDAE REGINAE No. 58 of 1975 An Act to amend the Motor Vehicles Insurance Act 1936-1975 in certain particulars [ASSENTED TO 27TH NOVEMBER, 1975] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same , as follows:-- 1. Short title and citation . (1) This Act may be cited as the Motor Vehicles Insurance Act Amendment Act 1975. (2) In this Act the Motor Vehicles Insurance Act" 1936-1975 is referred to as the Principal Act.

580 Motor Vehicles Insurance Act Amendment Act 1975, No. 58 (3) The Principal Act as amended by this Act may be cited as the ;Motor Vehicles Insurance Act 1936-1975. 2. Amendment of s. 4D. Section 4D of the Principal Act is amended by- (a) omitting subsection (3) and substituting the following subsection:- (3) Such corporation shall be constituted by- (a) the Insurance Commissioner, who shall be chairman; (b) three representatives of the insurers carrying on general insurance business in Queensland, elected as prescribed; (c) a representative of the Royal Automobile Club of Queensland, nominated by such Club, each of whom shall be appointed by the Minister by notification published in the Gazette and shall hold office for the term for which he is appointed unless he sooner dies, resigns or becomes incapable of performing the duties of his office."; (b) omitting from subsection (4) the second paragraph; (c) omitting subsection (5) and substituting the following subsection:- " (5) If a person to be appointed a representative mentioned in paragraph (b) of subsection (3) of this section is not elected as prescribed when and so often as required by the regulations the Minister may nevertheless appoint such person as he thinks fit to be such representative."; (d) omitting from subsection (9) the words " the elective representative " and substituting the words " elective representatives ". 3. Amendment of s. 4F . Section 4F of the Principal Act is amended by, in subsection (1), omitting from paragraph (b) all words from and including the words " the owner thereof " to the end of the paragraph and substituting the words " it is registered in accordance with the legislation of any other State or Territory of the Commonwealth that corresponds to the Main Roads Act 1920-1972 and in respect of which there exists a contract of insurance made pursuant to the legislation of any other State or Territory of the Commonwealth for the attainment of objects substantially similar to the objects of this Act ". 4. Repeal of s. 8A. The Principal Act is amended by repealing section 8A.

Motor Vehicles Insurance Act Amendment Act 1975, No. 58 581 5. Saving of office of existing representative members of Nominal Defendant . The members of The Nominal Defendant (Queensland) who at the date of passing of this Act hold office as representative members pursuant to paragraphs (b), (c) and (d) of subsection (3) of section 4D of the Principal Act shall be deemed to hold their offices, for the balance of the term thereof current at that date, as if they had been duly elected and appointed thereto as the representative members referred to in paragraph (b) of that subsection as amended by, this Act.
