228 Motor Vehicles Control Act Amendment Act 1988, No. 28 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title . This Act may be cited as the Motor Vehicles Control Act Amendment Act 1988. 2. Commencement . (1) Section 1 and this section shall commence on the day on which this Act is assented to for and on behalf of Her Majesty. (2) Except as provided by subsection (1), this Act shall commence on the day appointed by Proclamation. 3. Principal Act and citation as amended . (1) In this Act the MotorVehicles Control Act 1975-1985 is referred to as the Principal Act. (2) The Principal Act as amended by this Act may be cited as the Motor Vehicles Control Act 1975-1988. 4. Amendment of s. 4. Meaning of terms . Section 4 of the Principal Act is amended in the definition "public place" by inserting after paragraph (b), the following paragraph:- "or (c) a place for the time being declared by Order in Council not to be a public place for the purposes of this Act;". 5. Amendment of s. 25. Governor in Council may declare public places and exempt vehicles. Section 25 of the Principal Act is amended by- (a) in provision (a), inserting after the words "to be" the words "or not to be"; (b) inserting after provision (b), the following paragraph:- "It is competent to the Governor in Council to declare a class- (c) by reference to the place where or the purpose for which a vehicle is used for the time being or to any factor whatever that the Governor in Council thinks fit; (d) by excluding from the application of Part II all motor vehicles other than motor vehicles of a class or classes specified in the Order in Council."; (c) in the last paragraph, inserting after the words "to be" the words "or not to be". 6. Effect on contracts of insurance . For the purpose of construing the rights and liabilities of any person under a contract of insurance in force at any time before the commencement of this section, a motor vehicle used in Queensland in a public place within the meaning of the Motor Vehicles Control Act 1975-1985 at any time before the commencement of this section, shall be deemed not to be a vehicle in respect of which that Act required to exist at the time of such use a current certificate of registration or of renewal of registration issued under and in accordance with the Main Roads Act 1920-1972 (or that
Motor Vehicles Control Act Amendment Act 1988, No. 28 229 Act as amended for the time being) or under and in accordance with corresponding legislation of any other State or Territory of the Commonwealth or under and in accordance with the regulations made pursuant to the Motor Vehicles Control Act 1975 or that Act as amended for the time being. This provision does not apply to a motor vehicle in respect of which there was in force at the relevant time the required current certificate of registration or of renewal of registration.
