INSURANCE SURCHARGE) REPEAL

ACT

No. 8 of 1988

AN ACT to repeal the Motor Vehicle (Third Party Insurance

Surcharge) Act 1962, to amend the Motor Vehicle (Third

Party Insurance) Act 1943 and for connected purposes.

The Parliament of Western Australia enacts as follows:

PART 1—PRELIMINARY

Short title

1. This Act may be cited as the Motor Vehicle (Third Party

Insurance Surcharge) Repeal Act 1988.

Commencement

2.     This Act shall come into operation on the day on which it receives

the Royal Assent.

PART 2—MOTOR VEHICLE (THIRD PARTY INSURANCE SURCHARGE)

ACT 1962

Repeal of Act

3. The Motor Vehicle (Third Party Insurance Surcharge) Act 1962*

is repealed.

PART 3—MOTOR VEHICLE (THIRD PARTY INSURANCE) ACT 1943

Principal Act

4. In this Part the Motor Vehicle (Third Party Insurance) Act 1943*

is referred to as the principal Act.

Section 3P repealed

5.     Section 3P of the principal Act is repealed.

Section 3R amended

Section 3R of the principal Act is amended in subsection (4) (b) by deleting "all amounts received by the Board on account of the surcharge payable under the Motor Vehicle (Third Party Insurance Surcharge) Act 1962 and".

Section 4 amended

Section 4 of the principal Act is amended in subsection (8) (a) by deleting "together with the surcharge payable under the Motor Vehicle (Third Party Insurance Surcharge) Act 1962, in respect of that

Section 25 amended

8.     Section 25 of the principal Act is amended by deleting paragraph

(Ca).

PART 4—SAVING

Saving

(1) The provisions of the Motor Vehicle (Third Party Insurance Surcharge) Act 1962 and the Motor Vehicle (Third Party Insurance) Act 1943, as in force immediately before the coming into operation of this Act shall continue to apply to and in relation to

(a)

a surcharge payable in respect of the grant of a vehicle licence if that licence is granted before 1 July 1988; and

(b)

a surcharge payable in respect of the grant of a renewal of a vehicle licence if, pursuant to section 18 (4) of the Road Traffic Act 1974, that renewal has effect, or is deemed to have effect, on and from a day not later than 30 June 1988.

(2) In subsection (1)

"surcharge" has the same meaning as under the Motor Vehicle

(Third Party Insurance Surcharge) Act 1962;

"vehicle licence" has the same meaning as under the Road Traffic

Act 1974.
