MOTOR VEHICLE REPAIRS ACT 1980—REGULATION

(Relating to radiator repairers)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Motor Vehicle Repairs Act 1980, has been

pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1 April 1992.

Amendments

2. The Motor Vehicle Repairs Regulation 1982 is amended:

(a) by inserting in alphabetical order in clause 3 the following definition:

“radiator repairer” means a person who repairs radiators, heating equipment, thermostats or fuel tanks of motor vehicles:

(b) by inserting at the end of clause 3 the following subclause:

(2) Despite the definition of “radiator repairer” in subclause (1), a person who holds a licence or tradesman’s certificate in respect of the class of repair work of a panelbeater, body maker, automotive electrician, motor mechanic or motor cycle mechanic is not a radiator repairer for the purposes of this Regulation merely because, in the course of that repair work, the person may

be required to remove or replace a radiator, heating equipment, a
thermostat or a fuel tank of a motor vehicle.

(c) by inserting after clause 3A the following clause: Radiator repairer a prescribed tradesman

3B. For the purposes of the definition of “prescribed tradesman” in section 4 (1) of the Act, the class of radiator repairers is a prescribed class of tradesmen.

EXPLANATORY NOTE

This Regulation prescribes radiator repairers as a class of persons who must have

a licence or tradesman’s certificate under the Motor Vehicle Repairs Act 1980.
