Motor Vehicle Repairers Amendment

Regulations (No. 4) 2014

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Motor Vehicle Repairers Amendment

2.            Commencement

These regulations come into operation as follows -

(a)	regulations 1 and 2—on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations - on the day on which the Consumer Protection Legislation Amendment Act 2014 Part 8 comes into operation.

3.           Regulations amended

These regulations amend the Motor Vehicle Repairers Regulations 2007.
4.	Regulation 3 amended In regulation 3(1) delete the definitions of: licence notice replacement application replacement licence replacement licence notice transitional application transitional licence

5.            Regulation 5 amended

(1) Delete regulation 5(1).

(2)	In regulation 5(2) delete "(other than autogas work)".
(3)	In regulation 5 in the Table delete item 2A.

6.            Regulation 7A amended

(1)	Delete regulation 7A(1)(a) and (b).
(2)	In regulation 7A(1)(c) delete "in the case of any other' and
insert:
for an
(3)	Delete regulation 7A(2), (3), (4) and (5).
(4)	In regulation 7A(6) delete "that is not a transitional application or replacement application, regardless of the number of classes of repair work to which the application relates,".

7.            Regulation 7B deleted

Delete regulation 7B.

8.            Regulation 7D amended

In regulation 7D delete "prescribed for a business licence for autogas work -" and insert:

Note: The heading to amended regulation 7D is to read:

Conditions and restrictions attached to business licences

9. Regulation 7E replaced
Delete regulation 7E and insert:

7E.	Duration of business licence (Act s. 30)
For the purposes of the Act section 30, a business licence is to be issued or renewed for the period of 3 years.

10.          Regulation 7F amended

In regulation 7F(2) delete "application, regardless of the number of classes of repair work to which the application relates," and insert:

11. Regulation 7G amended
In regulation 7G( 1) in the definition of qualified repairer:

(a) in paragraph (a) delete "to which the business licence

relates; and" and insert:

carried out by the licensee; and

(b) in paragraph (b) delete "if the business licence relates to autogas work - a repairer" and insert:

if the licensee carries Out autogas work - a repairer

12. Regulation 711 deleted
Delete regulation 7H.

13.          Regulation 9 amended

Delete regulation 9(1)(g).

14.          Regulation 16 deleted

Delete regulation 16.

15.          Part 5 deleted

Delete Part 5.

16.          Schedule 1 amended

In Schedule 1 Form 1 delete "219 St George's Terrace Perth WA" and insert:
