Motor Vehicle Drivers Instructors Amendment Regulations 2024

Made by the Governor in Executive Council.

1.Citation

These regulations are the Motor Vehicle Drivers Instructors Amendment Regulations 2024.

2.Commencement

These regulations come into operation as follows —

• (a)

  regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;

• (b)

  the rest of the regulations — on the day after that day.

3.Regulations amended

These regulations amend the Motor Vehicle Drivers Instructors Regulations 1964.

4.Regulation 13B replaced

Delete regulation 13B and insert:

13B. Exemptions from Act’s requirement to have licence or permit

• (1)

  A person is exempt from section 5(1) of the Act if —

  • (a)

    the only consideration the person receives for acting as a driving instructor is 1 or more of the following —

    • (i)

      the reimbursement of reasonable expenses the person incurs in so acting;

    • (ii)

      remuneration that the person would receive even if the person did not so act;

    • (iii)

      remuneration covered by a monetary grant, or a portion of a monetary grant, designated under subregulation (2);

  and

  • (b)

    the person does not act as a driving instructor on a full‑time basis unless the person only receives consideration of a kind referred to in paragraph (a)(iii).

• (2)

  The Director General may designate a monetary grant, or a portion of a monetary grant, for the purposes of this regulation if —

  • (a)

    the monetary grant or portion is provided under an agreement between a person (the grantee) and the State; and

  • (b)

    under the agreement, the grantee is to use the monetary grant or portion to remunerate 1 or more other persons for acting as a driving instructor.

     
  5.Schedule 2 amended

At the end of Schedule 2 insert:

6.Various references to gender removed

Amend the provisions listed in the Table as set out in the Table.
