MOTOR TRAFFIC REGULATIONS 1935 - ORDER

NEW SOUTH WALES

The Roads and Traffic Authority, in pursuance of the Motor Traffic

Regulations 1935, makes the following Order.

Citation

1. This Order may be cited as the Motor Traffic (Speed Limiting)

Order 1990.

Commencement

2. This Order takes effect on 23 February 1990.

Manner of limiting speed and acceptable tolerance

3. For the purposes of Regulation 124 (2) (a) of the Motor Traffic

Regulations 1935:

(a)

the manner of limiting the speed of a coach or heavy motor vehicle approved by the Roads and Traffic Authority is by way of:

1990 - No. 109

(i)        geared speed limiting; or

(ii) a road speed governor; or

(iii)       an engine management system,

designed to limit the road speed of the coach or vehicle to not

more than 100 km/h; and

(b)

the maximum speed that is approved by that Authority as reasonable if any of those manners is used is 5% above the road speed to which that manner is designed to limit the coach or vehicle.

Designated sectors of public streets

4. For the purposes of Regulation 124 (2) (b) of the Motor Traffic

Regulations 1935, a length of public street extending between:

(a)

a sign that is in or similar to the form of Diagram 1 erected or displayed by the Roads and Traffic Authority on or near the street; and

(b)

the next sign so erected or displayed that is in or similar to the form of Diagram 2 and that faces in the same direction as the sign described in paragraph (a),

is declared to be a designated sector.

5. For the purposes of Regulation 124A (1) of the Motor Traffic

Regulations 1935:

(a)

the form of signs to be displayed on motor vehicles (the speeds of which have been limited) that is approved by the Roads and Traffic Authority is any of the forms shown in Diagram 3A, 3B or 3C, having the colours and not less than the dimensions specified for those Diagrams; and

(b)

the positions that are so approved at which those signs may be displayed on any such vehicle are such positions at the front and rear of the vehicle as allow the signs to be clearly seen from ahead of and behind the vehicle.
