An Act to amend the Motor Traffic Act, 1909, in relation to the driving of motor vehicles by children and in relation to the issue of penalty notices under section 18B of that Act in respect of certain offences under the Recreation Vehicles Act, 1983. [Assented to, 21st December,

Motor Traffic {Recreation Vehicles) Amendment.

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

Short title.

1. This Act may be cited as the "Motor Traffic (Recreation Vehicles)

Amendment Act, 1983".

Commencement.

(1) Sections 1 and 2 shall commence on the date of assent to this Act. (2) Except as provided by subsection (1) , this Act shall commence on the day appointed and notified under section 2 (2) of the Recreation Vehicles Act, 1983.

Amendment of Act No. 5, 1909.

  1. The Motor Traffic Act, 1909, is amended in the manner set forth in

Schedule 1.

AMENDMENTS TO THE MOTOR TRAFFIC ACT, 1909.

(1) Section 3 (1) (11) —

After "6", insert "or 6B".

(2) Section 6 B —

After section 6A, insert:—

Parents not to cause or permit children to drive upon public streets.

6B. (1) In this section—

"child" means a person who has not attained the age of 16 years

and 9 months;

AMENDMENTS TO THE MOTOR TRAFFIC ACT, 1909—continued.

"parent", in relation to a child, includes a guardian of the child and

any other person who stands in loco parentis to the child.

(2) Any parent of a child who, unless exempted by the regulations, causes or permits the child to drive a motor vehicle upon a public street shall be guilty of an offence under this Act.

(3) (a) Section 18B (1) (e)—

Omit "or" where lastly occurring.

(b) Section 18B (1) (f)—

Omit "vehicle,", insert instead "vehicle; or".

(c) Section 18B (1) (g)—

After section 18B (1) (f), insert:—

(g)

has committed any prescribed offence under the Recreation Vehicles Act, 1983, or any regulation made thereunder,
