AN ORDINANCE

To provide for the Registration of Motor Vehicles and

the Regulation of Motor Traffic.

BE it ordained by the Governor-General of the Commonwealth Council, in pursuance of the powers conferred by the Seat of of Australia, with the advice of the Federal Executive Government Acceptance Act 1909 and the Seat of Government
(Administration) Act 1910, as follows:—

PART I.—PRELIMINARY.

1. This Ordinance may be cited as the Motor Traffic Ordinance short title.

2. This Ordinance shall commence on a date to be fixed by the commencement.

4. (1.) In this Ordinance, unless the contrary intention Deflnitiona.

" Certificate of registration " means a certificate of registra-

tion of a motor vehicle granted under this Ordinance;

' ' Commission ' ' means the Federal Capital Commission;

. ___ " Driver ' ' means any person driving a motor vehicle and includes any person riding a motor cycle and " drive " includes " ride " ;

" Farmer " means a person who cultivates his own land or

that of another for his own profit;

" Licence " means a licence under this Ordinance;

" Licensed " means licensed under this Ordinance or the

Regulations;

' ' Motor car ' ' means any motor vehicle constructed to be used principally for the carriage of persons, but does not include a public motor vehicle or a motor cycle;

" Motor lorry " means any motor vehicle constructed to be used principally for the carriage of goods, wares, or merchandise, or for the conveyance of any kind of materials used in any trade, business, or industry, or for use in any work whatsoever other than the conveyance of passengers, but does not include a motor tractor;

" Motor omnibus " means any motor vehicle plying in a public street for hire for the conveyance of passengers at separate fares, not being a taxi-cab;

" Motor tractor " means any road oil or steam engine constructed to be used for agricultural purposes or in con- nexion with agricultural implements and machinery or for haulage purposes, but does not include any vehicle used on a railway or tramway;

" Motor vehicle " means any motor car, motor carriage, motor cycle, motor lorry, motor omnibus, motor tractor, or other vehicle propelled upon public streets wholly or partly by any volatile spirit or by steam, gas, oil, or electricity, or by any means other than human or animal power, but does not include any vehicle used on a railway or tramway;

" Owner " means the person in whose name a motor vehicle is

registered;

" Public motor vehicle " means a motor vehicle plying for

hire, and includes a motor taxi-cab;

" Public street " means any street, road, lane, thoroughfare,

footpath, or place open to, or used by, the public;

" Registered " means registered under this Ordinance;
" Regulations " means regulations made under this Ordinance;

" Trader's plate " means a number plate issued to a manufac-

turer of, or dealer in, or repairer of, motor vehicles;

" Vehicle " means any means of conveyance which runs on wheels but docs not include any vehicle used on a railway or tramway ;
' ' Visiting motor vehicle ' ' means am- motor vehicle registered outside the Territory and brought for temporary use into the Territory,

and any reference to a Schedule shall be read as a" reference to a Schedule to this Ordinance, and any reference to a form shall be read as a reference to a form in the Second Schedule.

(2.J Strict compliance with the forms in the Second Schedule shall not be required but substantial compliance shall be sufficient for the purposes of this Ordinance.

9.— (1.) The Commission may gran t a licence to drive a motor Granting «i

(.'{. I The Commission may grant a licence to ride a motor cycle to any person who satisfies it that he is not less than sixteen years of age and is capable of r iding a motor cycle with safety to the public, and the Commission may renew that licence from lime to time.

(4. A licence granted under (his section shall not be trans-

1 0 . — (1.) Any person who, while being tested for a licence to drive a motor vehicle, wears spectacles, shall wear spectacles while

d r iv ing a motor vehicle.

(2.) All such licences issued to persons who, while being tested, wear spectacles, shall be endorsed with, or bear on the f ront thereof the word " spectacles ".

Fees.

11 .— (1.) Prior to the registration or the renewal of registration of any motor vehicle, or the grant or renewal of a licence under the

last preceding section, payment shall be made of the fees specified in the Third Schedule, or such fees as are prescribed in lieu thereof, which are applicable to the case.

(2.) For the purposes of this Ordinance—
(a) the weight of a motor vehicle shall be ascertained as the

gross weight of the vehicle laden with the tools and accessories usually carried, with such fuel, water and oil as are in or upon the motor vehicle; and

(b) the weight upon which the fee specified in the Third Schedule is to be paid shall be reckoned to the nearest half hundredweight.

(b) be for one vehicle or for one person only;

(c) unless suspended or cancelled, be in force for one year from and including the date of issue.

(2.) Eve ry renewal of a certificate of regis t rat ion or licence shall commence on the day immediately following the day on which the certificate of regis t ra t ion or previous renewal thereof or licence or previous renewal thereof expired.

Production of 1 3 . — (1.) Where appl icat ion is made for regis t ra t ion of a motor

(2.) The owner of a motor vehicle shall upon registration
thereof cause two number-plates of the kind prescribed by the
Fourth Schedule or the regulations and of the size prescribed or
determined by the Commission, each bearing the registratio
number allotted to the motor vehicle, to be fixed upon it i
accordance with the requirements of the Fifth Schedule. I
(3.) Where a person is required to affix a number-plate to a motor vehicle in accordance with the provisions of this section, he shall affix the number plate supplied to him by the Commission.

16.— (1.) Where any number-plate has been lost or destroyed Lost

the owner of the motor vehicle to which it was affixed shall forward to the Commission a statutory declaration of the loss or destruction.

(2.) The Commission shall, if the motor vehicle has not also been lost or destroyed, and if satisfied that no improper use has been made of the number-plate, and on payment by the owner of the sum of Five shillings, supply the owner with a new number- plate.

(3.) Upon receipt of the new number-plate the owner shall forthwith affix the new number-plate on the motor vehicle in place of the number-plate so lost or destroyed.

(2.) No person shall drive a motor vehicle having upon it a number-plate other than that which was issued for that motor vehicle.

18.—(1.) Any person who sells, or otherwise disposes of, any sale or transfer

registered motor vehicle for, or on behalf of, the owner or any other person, firm or partnership, shall forward to the Commission forth- with-—

(a) each number-plate used in connexion therewith; (b) the certificate of registration of the vehicle;
(c) a written authority from the owner or any person entitled

to dispose of the vehicle to transfer the registration of

the vehicle;

(d) the full name and address of the person to whom the

vehicle has been sold or disposed of:

Provided that the number-plates need not be removed from the

vehicle if the vehicle is produced to the Commission for inspection.
(2.) An owner selling or disposing of his motor vehicle shall,
within seven days thereafter, give written notice to the Commission
of the sale or disposal, and if the purchaser, or the person, firm or
artnership to whom or which the owner disposed of the vehicle,
esides or carries on business in the Territory, the name and address

at the same time deposit with or forward to the Commission his
certificate of registration of the vehicle.

(3.) Unti l the provisions of the last preceding sub-section are complied with, the person in whose name the vehicle is registered shall remain liable as owner for any breach in respect of the vehicle of such of the provisions of this Ordinance as apply to an owner.

24 . The owner of a motor vehicle shall not place a frame or Number-piatw

2 5 . — (1.) A permit licence may be issued for any period not provision* for

a permit licence has been issued from driving a motor vehicle upon any public street while the permit licence remains in force if. while that person is learning to drive the motor vehicle, a licensed driver is occupying the seat next to the learner, and in that case the licensed driver shall be, deemed to be the driver of the motor vehicle.

(iii) affix the number-plates to the front and rear of the motor vehicle in respect of which it was issued so as to obscure the number-plates (if any) affixed to the vehicle under the law of the

State or Terr i tory whence it comes; and

(iv) upon leaving the Terr i tory re turn the number- plates issued in accordance with the provisions of this section.

C\ If the number-plates are returned, in pursuance of the ast preceding sub-section, in good order, the Commission shall efund the deposit of One pound.

(3.) A certificate of registration of a visiting motor vehicle

(4.) The owner or driver of a visiting motor vehicle, other thani a public motor vehicle plying for hire in the Territory, shall not bel required to be licensed under this Ordinance to drive a motor vehicle, and he shall be deemed to be so licensed under this Ordinance, provided he holds a licence under the law of the State or Territory whence the motor vehicle comes, corresponding to the licence which, but for this sub-section, he would be required to hold under this Ordinance. j

(5.) In the event of a visiting motor vehicle remaining in thel Territory for a period exceeding three months, it shall be deemed to have ceased to be a visiting motor vehicle within the meaning of this Ordinance, and the owner or driver thereof shall return the number-plates issued in accordance witli the provisions of this section, and shall apply for registration of the motor vehicle under section forty-one of this Ordinance.

(6.) In calculating the period mentioned in the last preceding sub-section, any periods during which the motor vehicle was tempo- rarily outside the Territory shall be included, provided the owner or the driver was ordinarily resident in the Territory during that period.

(7.) If the number-plates are returned in good order, the Com- mission shall apply the deposit of One pound towards payment of the registration fee for registration of the motor vehicle, or refund it, as it thinks fit.

(8.) If the number-plates issued to the owner or driver of a visiting motor vehicle are not returned in accordance with the provisions of this section, the deposit of One pound shall be forfeited to the Commission and paid into the Seat of Government Fund established under the Seat of Government (Administration)

Act 1924-1926.

PART I I I . — P U B L I C MOTOR VEHICLES .

27 .—(1) The Commission may gran t a licence to ply for hire from time to time.

(2.) A person shall not ply for hire with a motor vehicle unless a licence to ply for hire issued in pursuance of this Ordinance is in force in respect of tha t vehicle.

(3.) Every licence to ply for hire issued in respect of a public motor vehicle shall—

(a) be in accordance with Form B, BB, C or CC, whichever i l

applicable to the case;

(b) specify the number of passengers the vehicle may carry;

and

(c) unless suspended or cancelled, be in force for one year

from and including the date of issue.

(4.) Every renewal of a licence to ply for hire issued in respeel of a public motor vehicle shall commence on the day immediately following the day on which the licence or previous renewal thereof expired.

(5.) Any licence to ply for hire issued in respect of a public motor vehicle may be included in the certificate of registration issued in respect of that vehicle.

(6.) Prior to the issue or renewal of a licence to ply for hire in respect of a public motor vehicle, payment shall be made of the fees specified in the Third Schedule, or sucli fees as are prescribed in lieu thereof, which are applicable to the case.

(7.) The owner and the driver of any public motor vehicle which carries a number of passengers greater than that specified in the licence as the number of passengers which that vehicle may carry shall be guilty of an offence.
(8.) Every public motor vehicle shall have painted thereon, in legible letters in a conspicuous place, the number of persons the vehicle is licensed to carry, in one of the following forms:— " Licensed to carry persons "' or " Licensed to carry

persons inside and persons outside ", as the

case may be.

(9.) The owner of any public motor vehicle on which the number of persons the vehicle is licensed to carry is not painted in legible letters in a conspicuous place in one of the forms specified in the last preceding sub-section shall be guilty of an offence.

(10.) Any person who uses a public motor vehicle as a motor omnibus shall, unless that vehicle is registered as a motor omnibus, be guilty of an offence.

28.—(1.) The Commission may by notice in the Gazette stand?.

(2.) The driver of a public motor vehicle taking up a position on a public stand shall take up a position immediately in rear of any vehicle already on that stand.
(3.) The driver of a public motor vehicle occupying a position on a public stand shall forthwith drive his vehicle forward to the position on the stand vacated by any vehicle immediately in advance of his vehicle.

(4.) A person shall not cause or permit any vehicle other than a public motor vehicle to occupy a position on a public stand.

(5.) In this section " public stand " means a public stand for public motor vehicles other than motor omnibuses.

29. The owner of any public motor vehicle which is not "Fire

30.— (1.) Any person, firm or partnership who or which con- Licence to

so shall be guilty of an offence.

(2.) Any person, firm or partnership desirous of obtaining such a licence shall apply therefor in writing to the Commission stating—

(a) the proposed route of the service;
(b) the proposed scale of charges;
(c) particulars of the type of vehicle proposed to be used; and

(<7) the maximum speed at which it is proposed that the

vehicle will travel.

(ii.) The Commission may grant a licence to the person, firm or par tnership to conduct, subject to this Ordinance and the Regula- tions, a service in accordance with—

(a) the par t iculars contained in the appl icat ion; or

(&) such modifications of those par t iculars as the Commission

thinks fit,

and may renew the licence from time to time.
(4.) Every licence to conduct a motor omnibus passenger service shall be in accordance with Form It, and unless suspended or can- celled shall be in force for one year from and including' the date of issue, and any renewal thereof shall commence on the day immediately following the day on which the licence or previous renewal thereof expired.
(").) Pr ior to the gran t of a licence to carry on a motor omnibus passenger service or an}' renewal of the licence the pay- ment shall be made to the Commission of the fee of One pound.
(6.) The licensee under a licence granted under this section shall cause to be exhibited in a conspicuous place in every motor omnibus engaged in the service mentioned in the licence, while ply- ing for hire, a document bearing the approval of the Commission to the scale of charges for tha t service.
(7.) The licensee under a licence granted under this section shall comply in all respects with the par t iculars of that licence.
(8.) The Commission may at any time at the request of the licensee under a licence granted under this section, vary the par- t iculars contained in tha t licence and may endorse that variation on the licence.

(9.) A variat ion made under the last preceding sub-section shall not have any effect unti l the licensee has produced his licence to the Commission for the variat ion to be endorsed on the licence and unt i l the licence has been endorsed with that variation.

3 1 . — (1.) Where the driver of any public motor vehicle knows
that any person on his vehicle is suffering from any infectious

disease (which knowledge shall be deemed to be proved in the

absence of proof to the con t ra ry ) , he shall, as soon as possible after
setting down that person at his destination, disinfect the vehicle
to the satisfaction of the Commission.

(2.) Where, at any time after setting down at his destination any person who has travelled in a public motor vehicle, it comes to the knowledge of the driver of that public motor vehicle that that person was, while in the public motor vehicle, suffering from any infectious disease, the driver shall forthwith report that fact to the Commission, and shall, as required by the Commission, disinfect the vehicle.

(3.) The owner of the public motor vehicle may recover, in any court of competent jurisdiction, from the person who was suffering from the infectious disease or from his legal personal representative, the cost of disinfection.

(4.) The owner of the public motor vehicle shall not, after it
has come to his knowledge that the vehicle has been used to convev a

person suffering from any infectious disease, permit the vehicle to be used to convey any other passenger unt i l he has complied with this section.

3 2 . — (1.) Any property left by a passenger in a public motor i.ost property,

vehicle shall be handed over to the Commission.
(2.) The Commission shall hand the proper ty to the owner upon his establishing his ownership of the proper ty and paying a storage charge in accordance with a scale fixed by the Commission.
(3.) Any proper ty unclaimed at the end of six months shall be
sold by public auction and the proceeds paid into the Seat of

person, firm or company bona fide engaged in manufactur ing, deal- ing in or repai r ing motor vehicles, and having suitable premises for that purpose, and, in relation to each t r a d e r ' s plate issued, shall issue a certificate in accordance with Form S or T, whichever is applicable to the case.

(2.) Each person, firm or company to whom or which a t r ade r ' s

plate is issued shall pay to the Commission the sum of One pound per annum for each t r ade r ' s plate issued to that person, firm or company for use upon a motor vehicle, other than a motor cycle, and the sum of Two shillings and sixpence per annum for each t r ade r ' s plate issued to tha t person, firm or company for use upon a motor cycle.

3 5 . — (1.) A t rader ' s plate may, subject to this Ordinance, be Conditions of

(a) on trial, (luring the course of construction or repairs, or the par t s of the vehicle are in proper working condition ; (£>) on t r ia l for the benefit of a prospective purchaser or any person bona fide interested in the exchange of the vehicle;

after completion, for the purpose of ascertaining that

(c) proceeding to or re turn ing from a prospective purchaser

for or after t r i a l ;

(d) proceeding for delivery to a purchaser ;

(e) proceeding to or re turn ing from a workshop for painting

or r epa i r s ;

( /) proceeding to a railway station or wharf for carriage by

t ra in or shipment or from the station or wharf to the

premises of the t r a d e r ;

(g) proceeding to an exhibition or show for display or trial, or

re tu rn ing from the exhibition or show to the premises of

the t r a d e r ; or
(h) proceeding to or re tu rn ing with a disabled motor vehicle:

Provided that a trader's place which has been issued for use upon a motor vehicle, other than a motor cycle, shall not be used upon a motor cycle, and a trader's place which has been issued for use upon a motor cycle shall not be used upon any motor vehicle other than a motor cycle.

(2.) When any motor vehicle bears a trader's plate in any of the circumstances specified in this section the person driving the vehicle shall not be liable to a penalty under section twenty of this Ordinance.

36. A person, firm or company to whom or which a trader's plate is issued shall not use that trader's plate, or permit it to be used, otherwise than in the manner specified in the last preceding section.

Provided that a prospective purchaser may drive a motor vehicle or cycle having a trader's plate attached if he produces to the trader his licence so to do, and, in the case of a motor vehicle, one of the persons specified in paragraph (&) of this sub-section accom- panies him while driving.

(b) produce the record for the preceding three months for the inspection of any officer of the Commission in the execution of his duty or any member of the police force of the Commonwealth or a State.

PART V.—GENERAL.

4 1 . — (1.) Any person desirous of obtaining or renewing a Application for

certificate ot registration or of transfer of registration of a motor licences,
vehicle or a licence or a certificate relating to the issue of a trader's
plate, shall forward, to the Commission, an application stating his
address and any other particulars required by the Commission in-
cluding, in relation to a motor vehicle, the type, maker, horse-power,
motive power, weight unladen, and description of body.

(2.) Upon receipt of the application, the Commission may, by notice to the applicant, require him to attend at its office on the date specified in the notice.

(3.) The Commission shall supply the application form to appli- cants free of charge.

42.— (1.) Any person to whom a certificate of registration or a Acknowicdg- licence or a certificate relating to the issue of a trader's plate is registration, issued, shall acknowledge in writing its receipt.

(2.) Any person, on first receiving a certificate of registration or a licence or a certificate relating to the issue of a trader's plate, shall, upon application, be supplied, free of charge, with a copy of this ordinance and any regulations thereunder.

plate, shall, within seven days after any change of his address during the currency of the certificate or licence, give written notice thereof and bring or forward his certificate or licence to the Commission.

(2.) The Commission shall cause the new address to be en- dorsed on the certificate or licence which shall then be returned to the owner thereof.

44.—(1.) Whenever a certificate of registration or a licence or Lost certificate,

a certificate relating to the issue of a trader's plate has been lost or destroyed, the owner thereof shall forward to the Commission a statutory declaration of the loss or destruction, and thereupon the

certificate or licence shall become null and void.

(2.) The Commission shall, if satisfied that no improper use has been made of the licence or certificate, and upon payment by the owner of Two shillings and sixpence, issue to him a substitute for the licence or certificate in accordance with Form U, V, W, WW, X, XX, Y, or Z, whichever is applicable to the case, and the substi- tute shall then be deemed to be a licence or certificate, as the case may be.

45.— (1.) Any person to whom a certificate of registration or a Licence,

licence or a certificate relating to the issue of a trader's plate has ^'tobe*

(2.) Where a number-plate, delivered to the Commission under this section, is so defaced that, in the opinion of the Commission, it is not fit for further use, the owner shall pay to the Commission the sum of Five shilling's.

Defaced licence, 46.— (1.) Any person who—

(a) defaces his certificate of registration or licence or certifi-

cate relating to the issue of a trader's plate; or

(&) lends or parts with any such certificate or licence,

shall be guilty of an offence.

(2.) Any such certificate or licence which becomes defaced shall

be void.

(3.). The holder of a certificate or licence which is void by reason only of defacement may obtain a new certificate or licence on surrendering to the Commission the defaced certificate or licence and paying the Commission a fee of Two shillings and sixpence.

Refusal of 47. The Commission may—

certain cases. (a) refuse a licence to any person who has been convicted of being drunk while driving a motor vehicle, or of furiously or recklessly driving a motor vehicle, or who, in its opinion, is unfit to hold a licence; and
(6) cancel any licence issued to any person who has been con- victed of any offence which, in its opinion, renders him unfit to hold a licence.

PAKT VI.—RULES OP THE ROAD.

Driving on

public streets, 4 8 - -(1.) The driver of a motor vehicle upon a public street
Ac. shalt—
(a) keep the vehicle as near as practicable to the footpath on

his left side:

Provided that when the vehicle is proceeding at a rate

faster than six miles an hour it shall not be an offence
against this section if the vehicle is driven at a reason-
able distance from that footpath;

(b) when meeting a horse or vehicle, pass with it on his right

side;

(c) when overtaking a horse or vehicle pass with it on his left side, and not cross over to the left side of the public street until his vehicle is clear of the horse or vehicle which he has passed ;

(d) before stopping, drive the vehicle close to the footpath and

parallel thereto;

(e) when he is about to stop, raise his hand in such a manner as to be visible to any person immediately following or give such other signal as is prescribed ;

( / ) when he is about to reduce the speed at which his vehicle is travelling al ternately raise and lower his hand, with the palm downwards, in such a manner as to be visible to any person immediately following or give such other signal as is prescribed;

(g) when he is about to tu rn to the right, extend his r ight arm in such a manner as to be visible to any person im- mediately following;

(/() at all times comply with directions given by an officer of the Commission in the execution of his du ty or by a member of the police force of the Commonwealth or a State as to—

(i) the manner of approaching or depar t ing from any

place;

(ii) the manner of taking up or setting down pas-

sengers or loading or unloading goods; or

(iii) the regulation of traffic;

(i) before t u rn ing to the r ight from one public street into another, drive parallel to the footpath on the left side of the public street he is leaving unti l he is as near as practicable to the footpath on the left side of the public street he is en ter ing;

(j) whenever necessary, give sufficient warning, by sounding a
bell, horn or other alarm, of the approach of the vehicle

to any person walking, r iding or dr iving upon a public

s t reet ; and

(k) exercise due care, by slowing down, or, if necessary, stop-

ping, not to splash mud upon any person—

(i) in or upon or enter ing or leaving a s tat ionary

vehicle; or

(ii) wait ing at the stopping place of a public vehicle.
(2.) The driver of a motor vehicle shall not, unless the regula-

tions so prescribe, be required to observe the provisions of

paragraph (c) or ( /) of the last preceding sub-section, where there
is affixed to the rear of his vehicle, in such a position as to be

visible to any person immediately following, a lamp or other pre- scribed appara tus which clearly indicates to any person following that he is about to stop or reduce the speed at which his vehicle is travelling, as the case may be.

(3.) The driver of a motor vehicle upon a public street shall

not—

(a) negligently or wilfully obstruct, hinder, or prevent the

free passage of any person, vehicle, horse, cattle or t ram ;

(&) wilfully s top—

(i) between the near side of any vehicle stopped for the purpose of taking up or setting down pas- sengers or goods, and the footpath;

(ii) opposite to the entrance of any public street or across any passage, thoroughfare or foot cross- ing; or

(iii) upon the intersection of any public streets;

(c) leave the motor vehicle unattended in such a position as to obstruct the traffic or unreasonably cause inconvenience to any person;

(d) leave the motor vehicle without having taken due pre-

caution against its being started in his absence;

(e) permit any person to drive the motor vehicle without the

consent of the owner;

(/) cause the motor vehicle to travel backwards for a greater

distance or time than is requisite for safety or con- venience ;

(g) while driving the motor vehicle, be in such a position that he has not full control of the vehicle or has not a clear view of the traffic;

(h) cause or permit an undue amount of smoke to be projected

from any part of the vehicle;

(»') race with any other vehicle; or
{}) go upon any public street closed against traffic.
(4.) Subject to the next succeeding sub-section, when two motor

vehicles are approaching an intersection so that the vehicles would collide if each continued on its course, the driver of the vehicle having the other on its right shall reduce the speed of his vehicle.

(5.) Any driver of a motor vehicle entering from a side street, a thoroughfare declared by the Commission by notice published in the Gazette to be a main thoroughfare, shall give the right of way to the driver of a vehicle passing along the main thoroughfare.

(6.) In this section the expression " footpath " shall, where the footpath is not clearly denned, include the portion of the public street on the left of the carriage-way of the public street.

PAET VII.—OFFENCES.

49.—(1.) Any person who drives a motor vehicle upon a

public street at a speed or in a manner dangerous to the public,
shall be guilty of an offence.

In considering whether an offence has been committed under this section, the court shall have regard to all the circum- stances of the case, including the nature, condition and use of the public streets upon which the offence is alleged to have been com- mitted, and to the amount of traffic which was, or might reasonably have been expected to have been, upon that public street at the time.

(d) owns or drives upon a public street any unregistered motor vehicle having upon it any numbers or number- plate of a description prescribed to be affixed to registered motor vehicles, and calculated to deceive,

Motor vehicles 56 . Any person, other than the owner of a motor vehicle, who withouteconsent drives or uses that motor veliicle without first obtaining the consent

of the owner shall be guil ty of an offence:

Provided tha t the provisions of this section shall not apply to an officer of the Commission thereto authorized by the Commission for the purposes of this Ordinance or a member of the police force of the Commonwealth or a Sta te in the execution of his duty.

5 7 . Any person who procures the use or hire of any motor vehicle by fraud or misrepresentation, and any person who aids or abets that person shall be guil ty of an offence.

Nois«. 62. Any person who, upon a public street—

(a) drives any motor vehicle—

(i) unless an efficient silencer is affixed to the exhaust pipe of the vehicle and is used in such a manner that the exhaust is projected through through the silencer;

(ii) which causes undue noise by—

(1) being in a state of disrepair;

(2) the manner in which the vehicle is

loaded;

(3) the construction or condition of the adjustment of the machinery of the vehicle; or
(4) the construction or condition of adjust-

ment of the silencer ; or

(&) makes or permits to be made any unnecessary noise with the horn or other means of alarm affixed to a motor vehicle or makes or permits to be made, any such noise, other than as a warning of danger,

shall be guilty of an offence:

Provided that sub-paragraph (*) of paragraph (a) of this section shall not apply in respect of any motor vehicle driven in any motor vehicle reliability trial, or approved by the Commission under similar circumstances similarly approved.

Speed, &c 6 3 . Any person who drives a motor vehicle—

(a) at a greater speed than six miles per hour—

(i) while passing any school at a time when children

are coming out;

(ii) while passing a stationary tram or public motor

vehicle; or

(iii) while he has not a clear view of the traffic in the

direction in which he is travelling; or

(&) having more than one trailer attached thereto; or

(c) having a trailer attached thereto unless—

(i) the trailer is securely fastened close to the rear

thereof; and

(ii) the registered number of the vehicle is upon the rear of the trailer in a position satisfactory to the Commission and in figures of the same size and colour as those on the number-plate of the motor vehicle; and

(iii) when the motor vehicle is being driven between sunset and sunrise a lamp is affixed on the rear of the trailer so as to reflect on the registered number of the motor vehicle on the trailer ; and

(iv) the trailer does not exceed eight feet in width 1

measured between its extreme projecting
points; or

(d) unless an efficient horn or other means of alarm is attached

thereto; or

(e) unless efficient brakes are affixed thereto and to any trailer

attached to the vehicle ; or

(/) upon a footpath; or

(g) apparently used only for exhibiting an advertisement,

shall be guilty of an offence.

64.—(1.) Any person who commits an offence against, or con-Penalties for

travenes any provision of, this Ordinance or the Regulations, may be prosecuted summarily before any court of competent jurisdic- tion, and that court may, in respect of such offence or'contravention, impose a penalty not exceeding Twenty pounds or imprisonment for three months, and may—

(a) if the person convicted holds a licence under this Ordinance, suspend that licence for such time as the court thinks fit, and, if the court thinks fit, also direct that no licence shall be issued to that person during such further time after the expiration of the licence as the court thinks fit, or cancel the licence, and, if the court thinks fit, also declare the person convicted to be disqualified from obtaining a licence for such time as the court thinks fit; and

(b) if the person convicted is not the holder of a licence under this Ordinance, direct that no licence shall be issued to that person during such time as the court thinks fit.

(2.) Whenever the holder of a licence is convicted of an offence against or of a contravention of any provision of this Ordinance or the Regulations, the court shall cause particulars of the conviction to be endorsed upon the licence:

Provided that in the case of a conviction for a first offence against any provision of this Ordinance, the Court may exercise its discretion as to whether or not it will cause .particulars of the conviction to be endorsed on the licence.

(3.) Any holder of a licence so convicted shall produce the

licence within a reasonable time for the purposes of endorse-
ment, and if he fails to do so he shall be guilty of an offence.

(4.) A licence suspended in accordance with this section shall, during the term of the suspension, be of no effect, and a person whose licence is suspended or who is declared by the court to be disqualified from obtaining a licence, shall, during the period of suspension or disqualification, be disqualified from obtaining a licence.

(5.) If any person who, under the provisions of this Ordinance, is disqualified from obtaining a licence applies for or obtains a licence or a renewal of a licence while he is so disqualified, or if any person, whose licence has been endorsed, applies for or obtains a licence or a renewal of a licence without giving particulars of the endorsement, that person shall be guilty of an offence against this Ordinance, and any licence so obtained shall be of no effect.

((5.) A licence cancelled pursuan t to this section shall be of no

effect.

(7.) The court shall cause par t iculars of all convictions and orders to be forwarded to the Commission.

summary jurisdiction.

72. Each member of the police force of the Commonwealth or a Powers and

his opinion necessary for the safe and efficient regulation of the

7 3 . — (1.) The Commission may, by notice in the Gazette, desig- parkinu areas.

(2. ' Any person who drives a motor vehicle in the public streets or any par t of the public streets, or in the area specified in thf notice, at a speed greater than the limit of speed permitted thereir shall be guilty of an offence.

79 . The owner of any motor lorry shall cause his name and address to be painted in letters, a t least one inch in height, in a conspicuous position on the r ight-hand side of the lorry, and shall at all times mainta in tha t name and address on the lorry.

Refund of fees.

8 0 . The Commission may, whenever it thinks fit, refund to any person any fee under this Ordinance paid by that person or any portion of tha t fee.

Motor tractor. 8 1 . — (1.) Any person who brings into the Terr i tory, whether

for the purpose only of travelling- through port ion of the Terr i tory or otherwise, a motor t ractor not registered in the Terr i tory shall forthwith notify the Commission and pay to the Commission the sum of Five pounds.

(2.) I n the event of the owner or driver of the t ractor apply- ing for registrat ion of the motor vehicle under section forty-one of this Ordinance within three days after the date upon which the motor t rac tor was brought into the Terr i tory, the Commission shall apply the sum of Five pounds referred to in the last preceding sub-section towards the payment of the registrat ion fee for registra- tion of the motor tractor , but otherwise the sum of Five pounds shall be paid into the Seat of Government F u n d established under

the Seat of Government (Administration) Act 1924-1926.

Regulations.

8 2 . The Commission may make regulations, not inconsistent with this Ordinance, prescribing all mat ters which are required or permit ted to be prescribed or which are necessary or convenient to be prescribed for carrying out or giving effect to this Ordinance and in par t icular prescribing mat ters providing for and in relation

to—

(a) the licensing of conductors of any prescribed class of

public motor vehicles;

(b) the regulation of the grant of licences to those conductors, and of the renewal, transfer, suspension, cancellation and return of those licences;

(c) the fees to be paid for the grant and renewal of those

licences;

(d) the forms of those licences;
(e) the provision of number-plates additional to the number-

plates required by this Ordinance to be affixed upon public motor vehicles and the affixing and maintaining of those plates on public motor vehicles;

(/) the qualifications of drivers and conductors respectively of

public motor vehicles;

(g) the badges, if any, to be "worn by the drivers and con-
ductors of public motor vehicles and the form,
description, issue, wearing, and return of those badges;

(h) the form, construction, and equipment of public motor

vehicles;

(i) the amount of luggage and weight of goods to be carried in
or upon any prescribed class of public motor vehicles;

(j) the routes of motor omnibuses;

(k) the time to be taken by motor omnibuses for performing

the whole or any portion of their journeys;

(I) the publication of time tables;

(m) the prohibition of the setting down or taking up of

passengers by motor omnibuses at prescribed places;

(») the fares chargeable for the hire or use of public motor

vehicles plying for hire;

(o) the publication and the payment of those fares;

(p)

the paj'ment of so much of any fare for the hire or use of a public motor vehicle plying for hire agreed upon as does not exceed the prescribed fare;

(q) the pace at which public motor vehicles hired by time may

travel;

(r) the prohibition of misconduct by drivers and conductors of

public motor vehicles in any public street;

(s) the prohibition of any persons from touting or calling out or otherwise importuning any person to hire or use a public motor vehicle;

(t) the regulation of public motor vehicles and the holders of licences in respect of those vehicles and the drivers and conductors thereof and persons hiring or using those vehicles;

(w) the repeal or amendment or additions to the provisions of the Third Schedule, and, generally, for and in relation to fees for the registration or renewal of registration of motor vehicles, and the grant or renewal of licences; and

(v)    the registration of trailers and the fees to be paid for that

registration or its renewal.

1.—(1.) Registration or renewal of registration of any motor vehicle (being a motor lorry, motor omnibus, or motor car) :—

(a) Where the vehicle has pneumatic, semi-pneumatic rubber, or super-resilient

tyres— (i) Motor lorry—at the rate of 2s. 9d. per half cwt. of its weight:

Provided that the rate for a motor lorry owned by a farmer and used solely for the carting of his own produce shall be Is. 4£d. per half cwt. of its weight:

(ii) Motor omnibus—at the rate of 4s. 3d. per half cwt. of its weight;

Provided that in respect of any motor omnibus which runs to schedule times and at schedule rates there may be granted a special rebate by the Commission by notice in the Gazette ;

(iii) Public motor vehicle (other than motor omnibus)—at the rate of 3s. 3d. per half cwt. of its weight;

(iv) Motor car—at the rate of 2s. 9d. per half cwt. of its weight ;

(6) Where the vehicle has non-pneumatic or solid tyres—

THE FIFTH SCHEDULE.

MOTOR VEHICLES.

Conditions to be complied with before a Motor Vehicle is registered.

1. Particulars on application form shall be filled in by applicant.

2. The motor vehicle shall be produced at any time and place appointed by the

Commission.

3. The motor vehiele shall be capable of being so worked that it may travel either backwards or forwards and be capable of being readily steered.

4. The steering arms and connexions shall be of sufficient length and as far as possible protected from damage by collision.

5. All brake and steerage connexions shall be secured by bolts, the bolts shall be fitted with nuts, and the nuts shall be locked or pinned.

6. The motor vehicle shall have two independent brakes in good working order of sufficient strength so that either of them shall be capable of stopping and holding the vehicle under all conditions, and of such efficiency that theapplication of either shall cause two wheels upon the same axle to be effectually prevented from revolving, or shall have the same effect in stopping the vehicle as if those wheels were so held. Each brake shall be as far as possible so affixed as to be capable of easy adjustment and at least one must be made so as to be applied by the foot of the driver'.

No two brakes which operate upon the same part will be considered as independent, and at least one should act upon the road wheels without any connexion with the propelling gears.

Notwithstanding anything contained in this clause, no motor vehicle to which " Moore Transmission Gears " are attached shall be registered unless a " Moore Trans- mission Brake " is also properly attached to that motor vehicle.

7. Clauses 3 to 6 (both inclusive) of this Schedule shall not apply to motor cycles. In the case of a motor cycle one effective brake capable of stopping and holding the cycle shall be deemed sufficient.

8. All fittings shall be in such condition as not to be likely to cause annoyance, by bad smell or otherwise, or danger to any person upon the motor vehicle or upon a public street.

9. The lubrication of the engine and the carburation of the working mixture shall
be so controlled that smoke is not projected with the exhaust, or from any other part.

10. A lamp shall be suitably affixed to the offside or front of the motor vehicle, one other lamp shall be affixed on the off side of the rear of the motor vehicle and shall be so affixed as to reflect upon the rear number-plate, and so that it cannot be lit or extinguished by any person white in or upon the motor vehicle.

11. A suitable attachment shall be securely fastened in an approved position at the

front and also at the rear of the motor vehicle, of a size satisfactory to the Commission,

for the purpose of affixing the number-plates, and a lamp bracket shall be affixed at the rear of the motor vehicle to hold the rear lamp in such position as to reflect
upon the rear number-plate.

The lamp-bracket shall be so affixed as not to obscure any portion of the rear number-plate.

12. An approved bell or alarm, or other means of giving due warning of the approach
of the motor vehicle, shall be attached to the motor vehicle in a convenient position.
13. The motor vehicle shall not exceed 8 feet in width, measured between its
extreme projecting points.

14. The motor vehicle shall have an efficient silencer so made and affixed that the exhaust shall be projected through the silencer.

15. A side-car shall not be affixed upon the right-hand side of any motor cycle.

16. («) In each application for registration of a motor vehicle the weight unladen,
and the width and material of the tyres, when other than rubber tyres, shall be stated.
(6) If required, the vehicle shall be weighed in the presence of an officer of the

Commission thereto authorized by the Commission.

17. On all motor lorries the name and address of the owner shall be painted in plain block letters on the oft' side of the vehicle and of any trailer.
