MOTOR TRAFFIC, METROPOLITAN TRAFFIC AND

LOCAL GOVERNMENT (AMENDMENT) ACT.

BE

. An Act to provide for the regulation of passengers in motor vehicles; to make further provision with respect to the control of traffic on public streets and procuring the use or hire of motor vehicles by fraud or misrepresentation; for these and other purposes to amend the Motor Traffic Act, 1909-

1966, and certain other Acts; and for purposes

BE it enacted by the Queen's Most Excellent Majesty, by
and with the advice and consent of the Legislative
Council and Legislative Assembly of New South Wales in
Parliament assembled, and by the authority of the same, as
follows: —

1. (1) This Act may be cited as the "Motor Traffic, Metropolitan Traffic and Local Government (Amendment) Act, 1966".

(2) The Motor Traffic Act, 1909, as amended by subsequent Acts and by this Act, may be cited as the Motor Traffic Act, 1909-1966.

(3) The Metropolitan Traffic Act, 1900, as amended by subsequent Acts and by this Act, may be cited as the Metropolitan Traffic Act, 1900-1966.

2. The Motor Traffic Act, 1909, as amended by subse- quent Acts, is amended—

(a) (i) by inserting at the end of paragraph (i) of subsection one of section three the words "and of persons in or upon or entering or alighting from motor vehicles";

(ii)   by inserting in paragraph (a) of subsection two of the same section after the words "por-

(iii)   by omitting from paragraph (b) of the same subsection the word "either" wherever occurring;

(iv)   by inserting in the same paragraph after the words "specified public streets", where firstly occurring, the words "or to all public streets other than those specified";

(v)   by inserting in the same paragraph after the words "specified public streets", where secondly occurring, the words "or to parts of public streets other than those specified,";

(vi)   by inserting in the same paragraph after the words "during specified times" the words "or at times other than those specified";

(vii)   by inserting in paragraph (c) of the same subsection after the word "cases" the words "or for all classes of cases other than that specified";

(viii)   by inserting in paragraph (d) of the same subsection after the words "description of motor vehicles" the words "or to motor vehicles other than those of a specified class or description";

(ix)   by inserting at the end of the same paragraph the following words : —

For the purposes of any regulation the expression "class or description of motor vehicles" includes vehicles classified or described according to the direction in which the drivers thereof are travelling or in which

the drivers thereof turn or propose to turn the
vehicles or the projected destination of the drivers thereof or such other circumstances or matters as the regulation specifies.

(b)

by omitting from section 8B the words "motor car" and by inserting in lieu thereof the words "motor vehicle";

(c)

(c) by inserting next after subsection four of section

18A the following new subsection: —

(4A) A statutory declaration which relates to more than one parking offence shall not be deemed to be a statutory declaration under, or for the pur- poses of, subsection three of this section.

3. The Metropolitan Traffic Act, 1900, as amended by subsequent Acts, is amended by inserting at the end of section seven the following new subsection : —

(2) (a) Any regulation with respect to public streets may be made to apply to all public streets or to any specified public streets, or to all public streets other than those specified, or to parts of specified public streets or to parts of public streets other than those specified, and at all times or during specified times or at times other than those specified, and unless otherwise provided or clearly intended, shall apply to all public streets, and to the whole thereof and at all times.

(b) Any regulation may be made to apply either to all vehicles or to any specified class or description of vehicles or to vehicles other than those of a speci- fied class or description, and unless otherwise provided

or clearly intended shall apply to all vehicles.

For the purposes of any regulation the expression "class or description of vehicles" includes vehicles classi- fied or described according to the direction in which the drivers or riders thereof are travelling or in which the drivers or riders thereof turn or propose to turn the vehicles or the projected destination of the drivers or riders thereof or such other circumstances or matters as the regulation specifies.

4.     The Local Government Act, 1919, as amended by sub-

sequent Acts, is amended by inserting next after subsection
four of section 270o the following new subsection : —

(4A) A statutory declaration which relates to more than one parking offence shall not be deemed to be a statutory declaration under, or for the purposes of, sub- section three of this section.
