MOTOR TRAFFIC (FEES) AMENDMENT ACT.

Act No. 35, 1949.

An Act to make provision for and in respect of increases in certain fees payable under the Motor Traffic Act, 1809-1949, and the Transport Act, 1930-1948; to amend the said Acts in certain respects; and for purposes connected therewith. [Assented to, 12th November, 1949.]

1 . (1) This Act may be cited as the "Motor Traffic (Fees) Amendment Act, 1949." (2)

BE it enacted by tbe King's Most Excellent Majesty, lative Council and Legislative Assembly of New South by and with the advice and consent of the Legis-

Wales in Parliament assembled, and by the authority of tbe same, as follows :—

(2) The Motor Traffic Act, 1909, as amended by

subsequent Acts and by this Act, m a y be cited a s the

Motor Traffic Acts , 1909-1949.

(3) The T r a n s p o r t Act , 1930, as amended by

subsequent Acts and by this Act, may be cited as the

T r a n s p o r t Act, 1930-1949.

(4) This Act shall commence upon a day to be

appointed by the Governor and notified by proclamat ion

published in the Gazette.

2 . The Motor Traffic Act, 1909, a s amended by

subsequent Acts , is amended—

(a) by inserting next after section 5A the following
new sect ion:—

5B. (1) E v e r y motor vehicle (o ther t han a

motor vehicle exempted f rom regis t ra t ion by or under this Act) shall be regis tered before being used or dr iven upon a public s t reet .

(2) Regis t ra t ion or renewal of reg is t ra ­

t ion of a motor vehicle effected af ter the commencement of the Motor Traffic (Fees ) Amendment Act, 1949, shall be for a per iod not exceeding one year .

(b) by omitting the first five items in the Schedule
there to a n d by inse r t ing in lieu thereof the

following:—

In this Schedule—

"License" includes renewal of license.
"Motor cycle" means any motor vehicle which is steered by means of handle bars and has

two wheels, or where a side-car or side-box

is attached thereto, has three wheels.

"Registration" includes renewal of registration.

Registration fee to be paid by the applicant upon his

application for registration of the vehicle—

(a) Any motor vehicle (not being a motor cycle or a motor vehicle referred to in para­ graphs (c) and (d) of this item)—

(i)   where registration is effected for a period exceeding three months—one pound five shillings;

(ii)

(ii)  where registration is effected for a period not exceeding three months —seven shillings and sixpence.

(b) Any motor cycle—

(i)  where registration is effected for a period exceeding three months—ten shillings;

(ii)  where registration is effected for a period not exceeding three months— three shillings.

(c) Any motor vehicle constructed principally to carry persons, equipped to seat more than eight adult persons (including the driver) and in respect of which payment is received for the conveyance of passengers on a public street—

(i)  where registration is effected for a period exceeding three months—two pounds;

(ii)  where registration is effected for a period not exceeding three months— twelve shillings.

(d) Any motor vehicle constructed principally to carry persons, equipped to seat not more than eight adult persons (including the driver) and in respect of which payment is received for the conveyance of passengers on a public street—

(i)  where registration is effected for a period exceeding three months—one pound ten shillings;

(ii)  where registration is effected for a period not exceeding three months— nine shillings.

Motor vehicle driver (not being the rider of a motor vehicle which has less than four wheels and is steered by means of handle bars)—Fee, fifteen shil­ lings, to be paid by the applicant upon his applica­ tion for the license.

Motor cycle rider (being the rider of a motor vehicle which has less than four wheels and is steered by means of handle bars)—Fee, ten shillings, to be paid by the applicant upon his application for the license.

Learner's permit—Fee, five shillings, to be paid by the applicant upon his application for the permit and for each renewal thereof.

3 .    The T r a n s p o r t Act, 1930, as amended by subsequent

Acts , is amended—

(a) by omitting from subsection one of section one hundred and forty-six the words " o f one y e a r f r o m " and by inser t ing in lieu thereof the words
" n o t exceeding one yea r t e rmina t ing o n " ;
(b) by omitting item five of Schedule Two and by inser t ing in lieu thereof the following i tem:—

(a) Motor omnibus—
(i) where registration is effected for a period ex­ ceeding three months £3, less any fee

paid in respect of the same per­ iod for a provi­

exceeding three months 18s., less any

fee paid in re­ spect of the same period for a pro­ visional registra­

tion certificate
for the same
motor omnibus.
(b) Taxi-cab—

(i)

where registration is effected for a period ex­ ceeding three months

£2.

(ii) where registration ii

effected for a period not

exceeding three months 12s.
(c) Private hire car—

(i)

where registration is effected for a period ex­ ceeding three months

£1 10s. 0d.

(ii)

(ii)   where registration is

effected for a period not

exceeding three months 9s.
(d) Other public vehicle—

(i)

where registration is effected for a period ex- ceeding three months

£1 5s. Od.

(ii) where registration is

effected for a period not

exceeding three months 7s. 6d.

4 . The amendments made by sections two and three of this Act to the Motor Traffic Act, 1909-1949, and the Transport Act, 1930-1948, shall apply to and in respect of registrations, licenses and learners' permits under those Acts, and renewals thereof, which are to take effect on or after the commencement of this Act whether application therefor was made either before or after such commencement.
